Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    As a service Tech , We have seen and have replaced many spiders on Samsung washer and from the washers we have worked on the spider get caked up with soap eating away at cast metal.
    I do believe they could power coat these spider to stop some of this from happening. But from what we see in most cases is users using way to much soap in these washers and that is in all brands of front load washers these machine use less water there for to much or even the wrong kind will eat away at any materiel including your cloths Lite up on your soap front load user’s this will help make washer last longer and save you money.
    Samsung washers are the lowest priced in front load washers as for buying New and reading owners manual will make you use the way they are made to be. old laundry habits will not work with these time to re educate the way you wash your cloths still do think they can make them better but better come’s with more cost Buy your extended warranty and keep it renewed and your cost will be your savings any repair on front loaders as for inner outer tubs is in the $300 to $400 price for repair. appliancetech40@gmail

    Is there a class action law suit on the recalled samsung washers? My pump exploded and did 10000 worth of damage. Samsung keeps telling me their insurance will be calling since jan 23.

    Samsung ANB 330. Overpriced piece of crapp. Broke twice in 6 years.. 80.00 door seal.. If you do it yourself. Spider gear now they tell me, not worth fixing they also tell me. Oh yes, and you must always leave the door open so your clothes don’t smell.
    Off to buy a NOT Samsung

    On February 8, 2010 I purchased a Samsung Front load washing machine model WF218ANW. Today, while washing three towels and three hand towels the machine started making noise I have not heard before like a squealing noise. The timer showed one minute left without any warning codes in red. I stopped the washer and when I opened the door there was tons of smoke coming out from the drum area. The machine kept smoking for several minutes (5) and I just about called 911. Later I checked the filter area and now know what “chip metals” are. I also had a piece of what looked like the inside of the washer about an inch long. I called Samsung and they should be calling me in 24 hours. I would hate to see what may have happened had I not stopped the washer or if I was not home. Let me know if anyone wants a picture of the metalish chip. My washer is not used excessively as I am the only one in the household.

    Bought my samsung washer and dryer new in 2011 and have had nothing but problems..i personally replaced 2 heating elements on the dryer and had the drum replaced by samsung because of a cracked drum…the washer always smells moldy and it always has been horrible about spinning out properly…ive also replaced the drain pump 6 months ago and now tonight it sounds like the spider arm assembly might need replacing! Ive had machines that went for 15-20 yrs before even needing any service these front loading machines are garbage compared to the ones i grew up with.

      This is the same with my son’s they have replaced 4 or 5 heating elements on the dryer hardly any of the front panel works and you can only dry on one cycle or it turns of after about 4 minutes

    I have a Samsung model number wf330anb/xaa 07
    I believe the bearings in the drum are gone possibly more
    I don’t know what to do
    I’m really pissed as this was not cheap
    We have all Samsung appliances
    I would like something done about this as they have made thousands of us
    Can someone please help

    My Samsung washer started emptying the water as fast is it was going in yesterday. Had we not been home the damage would have been extremely worse. I called.Samsung for service. They asked for my model # along with some other info and said that someone would get back to me. Several hours later I received a call from some sort of agency that organizes the techs in my area. I was told that the first available appointment was Thursday Oct 27th; 6 days later! There would be a $90 charge to come out (whether they fixed anything or not) plus $75 per hour labor plus parts. We decided to go to Lowe’s to see if it would be more cost effective to just buy a new washer. Once there we noticed that there weren’t any Samsung washers or dryers. The salesperson told us that there had been a recall. She looked up our model number and ours happened to be on it!!! Why didn’t Samsung tell me about the recall when I gave them my model #? Why would I pay to have a washer fixed that could potentially have more problems? I called Samsung back this morning and Jose informed me (after he looked up my model and serial #) that my washer had been recalled. He told me that someone from the “recall dept” would call me within 48 workday hours. The part that really aggravated me was that he said “you had it for 4 years”. Since when do appliances only last for 4 years? Samsung needs to work on the quality of their products along with their customer service. My new Maytag washer gets delivered tomorrow; 4 days before the service guy was supposed to show up. If there is still a class action law suit I wouldn’t to be included.

    I commented a couple of months ago, and even recieved 1 phone call regarding the samsung washing machine. and was told someone would be getting a hold of me again soon. Soon has passed and I would like to know what is going on with my complaint. I still have the Washer, Not in use, and I would never sell it off to someone else as it has many stinky problems. my name is Karen Herzog my number is 812-547-2147, or 812-719-0399 and would appreciate some type of notification of what is going on. I personally know people that have recieved money already and their complaint was filed after mine.

    I had the shaft of the drum break on mine. With not even a warning. Pretty sure that’s a huge defect.
