Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    I have the same problems listed the Spider Arm Assembly gets rotten even in minimum use because of the erosion caused by difference between the metal used for the drum and the weaker metal used for the spider arm. My best advised that I learned the hard way is never buy Samsung Washers or Dryer because the Dryer belt drum is not a costly repair but annoying to have to replace often . I will never buy another Samsung washer or dryer

    Same problem on my 2011 WF350ANP/XAA. Spider arm has completely disintegrated, causing damage to various other parts. Washer is beyond economical repair, but other than the spider arm, everything looks new.
    I called Samsung technical support who said they’ve never heard of this problem.
    A local appliance parts store said they sell at least one per week.

    Purchased my Samsung front load washing machine new in 2011. Spider arm is now broke and the repair is $800. I am an empty nester and only do 1-2 loads of laundry a week, this machine is no where near it’s “service life”. Guess which brand I won’t be buying again. Is there a class action for this issue?

    Our wf337AAG/XAC Samsung washer was purchased in 2009 and under single family use, we are having the same problem with chunks of pop metal in the large drain hose that leads into the pump. It’s clear that the larger pop metal pieces that have been coming off the drum support have caused obstruction to the pump being able to drain water and in my case a larger chunk of pop metal got lodged in the pump causing the pump to seize/fail. If Samsung wants to stay in this business they need to improve and recall this drum support part as clearly this is an engineering/material defect in their product.

      Same issue with my Samsung washer, (WF306LAW/XAA), purchased 12/2006.
      Pieces got stuck in the drain pump causing the pump to stop working. Luckily I caught it in time ,but had to remove the pump and dislodge the pieces of stone/metal (about 4-5 pieces) , then reassemble. Now works fine again. If I didn’t hear it stop working , this would have burnt-out the drain pump! Hopefully this won’t happen again, or affect future operations.

    My Samsung front loader is having the problem of pot metal ending up going through the hose and clogging the exhaust pump. The pot metal is coming from a bracket holding the drum in place that is made with inferior metal causing it to disintegrate one piece at a time. Samsung has been doing this for years knowing there is a problem.

      Hi Joe the metal is chunks of Aluminum coming off the Spider Arm that secures the drum to the motor at the back. This is all internal inside the drum housing. I changed my spider arm myself. Not an easy job but my labor was free. All the spider arms made out of cast aluminum fail after around 7 – 12 years.

    Hello I own a Samsung Front Load washer #WF330ANW.

    I am always cleaning / drying the washer. I am not able to control the mold or the smell.

    The little filter basket always has tiny little metal balls.

    I also get tiny holes in my clothes for some reason.

      Hi Donna do you always leave the front door of the washer open all the time except when using it? We do… no smell or mold. is the washer in the basement or damp area of the house?

    have the same problem. first I thought my kids left rocks in their pockets.. but after closer inspection found that it was metal pieces.. it made a hole In the bottom tub and rib the gasket around the front door.. all the these parts cost as much a new washer..which we can’t afford now..

    My Samsung Washer ( Model # wf419aaw xaa 01) is broken. Samsung set up a local technical visit and he just spent couple minutes and said that unit needs to replaced. The back support which rotates the drum is broken and debris were found with water in the water outlet.

    This is worst product. Samsung is making these products since long and I now see, how many pieces don’t even last couple of years.

    Let’s spread the word – AVOID SUMSUNG Products.

    Our wf337AAG/XAC Samsung washer was purchased in 2009 and we too are now having the same problem. Leaking drain pump and chunks of metal in the large drain hose that lead to the pump. It’s clear that the sediment and metal pieces that have been coming off the drum support caused the pump to fail and leak all over our laundry room floor. I contacted Samsung and they refuse to acknowledge the problem and said it’s the first they heard of it. What a joke

      I’m having the exact same issues I have a Sears warranty and they have now come out and replace the pump spice it is only because I started researching that I found out about this problem looks like I’m going to have to buy a new washer
