Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    I myself had to replace the discharge pump three times already and now I have to do it again, I thought Samsung was a good product but the washing machine really sucks they should really do something about that, the consumer should deserve better for their money

    I purchased a Samsung front load washee July 2020 and last month it made popping sound like it hit something went to my lundry room to see what happened and the machine was almost of the pedestal and when I wash the drum makes a load noise. The technician came out and took the machine apart and said I need a new drum. I have NOT HAD THE WASHER 1 YEAR. Samsung SHOULD REPLACE THE WASHER BUT I DOUBT THEY WILL.

    Having ssme issue husband took apart after i ordered bearing and it was spider arm/flange shaft it was just about decentegrated one arm completely broke off it was terrible .. Havnt had washer just right at 3 years and done had to calk samsung out once before because washer wouldnts start due to door not latching so they had to repkace latch and weve also git the leaking door! This is just insane , we pay so much for something nice hoping it lastes and this is the type of mess we get for buying pricey items! I can assure you that how ever many years i have to live i will never purchase another samsung washer or prob never another Samsung ANYTHING FOR THAT MATTER!

    Same issue occurring in our Samsung Frt Load Washer. Looks as if we hardly use it but this strange Gritty/Metallic Debris similar to Heavy Beach Sand isn’t clogging the Front Drain pump Clean out it is just constant breakdown of this certain type of alloy they speak of. The Huge Problem is that the Washer Drum itself will turn Counterclockwise but when it reverses it actually gets jammed up by these Large(2″x 1″)chunks of broken shrapnel from something totally disintegrating between the Outer Plastic Drum(Housing)and the Drum itself. This is outrageous to have occurred in a washer with such little hours on it. I want to get to the bottom of this since this is a HUGE, “Design/Engineering/Manufacturing Material Flaw. This was done by the Design and Engineering Team to completely limit the Functional/Working Life-Span of the Washer Drum and Bearing Assembly itself! This is getting me more and more infuriated the more that I think about it and continue to look into this problem. This is more is more commonly known as “Design Failure” of a part that they purposely did Designed to fail at the Samsung Design & Engineering Facility! The Manufacturing and Engineering Team/Platform always know when a Part is going to fail from there rigorous testing that must be done prior to Release for Production.

    I also have a samsung andvit has exactly the same issues with the spider degrading the drum is loose and it isn’t worth fixing unless o can get a spider made of a diffferent metal has Samsung addressed the issue ? Is their a recall ?
    The machine looks brand new and has been well cared for

    Decomposition and failure of shaft assembly (aka: spider gear; slang). Shaft assembly
    Main body alloy is highly reactive to detergent surfactants resulting in the rapid decomposition of the alloy and premature failure. Detergents cause metal to quickly rust and break apart. Without question this is an intentional act by Samsung Corperation to “shorten the lifespan” of the product and clearly is not an accidental oversight. Samsung without question was aware of the defect by the many customer complaints of premature product failure of all models using this substandard alloy.

      Great and you seem to actually know what you’re talking about, but I hope Samsung can afford to buy me a new washing machine because 3 technicians and several replacement parts later, I certainly can’t afford to! Is there any way to repair or deal with this at all, or are we all just supposed to suffer? I will say that I’ll second guess all appliance purchases from now on.

    We just had the same issue of smoke and pieces of metal in the filter. Ours is a 2009 front loader. Samsung customer service: We can’t help you because the unit is out of warranty. Oh and because it can’t be repaired because we don’t make the spider part that broke anymore. So, yes, you are out of luck. Thank god we were home because the machine continued the spin cycle while burning. Filled our house with smoke. Good times with everyone in quarantine.

    I have a new Samsung washer that is top loading. after only about 6 weeks we saw a crack in the top plastic piece that has the bleach dispenser. it was repaired about ten days ago and now the brand new top is cracking again. has anyone else had this happen?

    WE OWN A SAMSUNG WASHER. OUR SPIDER ARM/FALANGE HAS COMPLETELY ROTTED FROM THE INSIDE. WHEN WE CALLED SAMSUNG THEY TOLD US THEY HAVE NEVER HEARD OF THIS PROBLEM AND THEY HAD NO IDEA HOW TO EVEN FIND THE PART NUMBERS WE NEEDED TO REPLACE IT. ITS OFFENSIVE TO CONNECT WITH SUCH A HUGE COMPANY AND HAVE NO ONE BE ABLE TO HELP YOU OR TAKE RESPONSIBILITY
