Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    I checked my serial number and model # wa422prhdwr/aa with Samsung recall and was advised it was one included in recalls. Samsung requested my info and has not returned a message on what they will do.
    What a waste of money. The banging of the drum spinning, smell of all our clothes and bedding. Time and money wasted on this machine. Moved machine out of the way and purchased a Whirlpool.
    Samsung can buy it back!!

    How do I become a part of the Class Action Lawsuit? I just seen a report about it on the local news. From reading just about all of these comments it seems as though I am not the only one the is unhappy/Pissed off about the defects and out of pocket expenses.

    We just replaced our 4 year old Samsung front loading washing machine. Repair man noted rubber torn from door seal needed to be replaced, musty moldy smell and I CLEANED it regularly and left the door open, the drum had warped from it spinning badly so it was cheaper to replace it rather than repair it! VERY unhappy as I’m disabled and husband is retired so we can’t afford this!

    I bought a washer thru Blue Ribbon rental.It is a Samsung.It has always had a leakage when running.I has gotten worse and the error,DC comes on more frequently now.I had a repair guy check it and he said maybe I was putting too lg a load in so I made them smaller.I still does it.I am going to get a new one shortly and it won’t be a Samsung.It also doesn’t have an agitator and doesn’t clean good.

    The drum of our five year old Samsung front loader WF210ANW/XAA started to wobble seriously and make noises while running. When I took it apart I found the aluminum support brace that connects the drum to the motor was so badly corroded only one of the three legs was still connected to the motor shaft, the others had completely corroded away! Even the dumbest first year engineer knows that you can’t mix aluminum and stainless steel in a wet environment, especially when electricity is involved. This is a very dangerous, poorly designed, piece of equipment that should never be on the showroom floor! I can furnish photo’s if necessary!

    Having the same problem with the Samsung VRT top load machine not spinning all the water out of the clothes. It does the spin, fill, spin, fill for hours then the clothes are still wet. The timer goes from 12 minutes remaining to 17 minutes remaining and never spins all the water out of the clothes. It also leaks and makes noise. Machine was brought in 2013 and already has rust around the bleach reservoir. Inside the machine when the panel was taken off is nothing but plastic. What a waste of money. Last machine I had lasted 30 years with one repair which was less than a hundred dollars.

    I have the Samsung VRT Stream front loader. We got the washer from Lowes. When I called for service because iwas NOT cleaning my clothing. The serviceman discovered the hot and cold was switched when Lowes installed it and suggested I use Tide “he” tablets. I showed him the tablets. I have owned Kenmore without problems using Tide, Cheer, Gain or All. This is by far the worst washer I have ever owned. If you are expecting clean clothing, do not waste your money. I am buying more white t-shirt than ever. You can’t wash them before wearing without the color looking aged. Husbands, buying the Samsung front loader maybe grounds for divorce.

    Bought samsung he top loader in 2013. Within 6 months had drain pump replaced twice. From day 1 machine was GARBAGE. Main board went out, dc error code, broken drum. No matter how much or little was put in to be washed it would never finish the spin cycle. Spin-stop-fill-spin-stop-refill-repeat till error. Samsung appliances are total GARBAGE, their customer service us total GARBAGE.

    I own a Samsung frontload washer and it has been making a very loud noise supposedly it’s a VRT model and also has a terrible mold odor even when the door is been left open after each wash. I have paid out over $450 to maintenance and service my washer and trying natural remedies in between to maintain the cleanliness and it still has such a foul mold smell. Very dissatisfied with my Samsung washer!
