Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    My washer and dryer are two years old and are giving me problems the washer leaks from time to time repair guys can seem to find the problem the dryer makes this terrible squeaking noise that got fixed and still is making the noise the warranty I bought for five years doesn’t seem to care and just want to basically screw me over and not fix my appliances they want me to pay out of pocket for the repair guys to come need help not happy with the appliances at all

    Bought a top load washer in July of 2012. It worked for 2 years then the discharge hose snapped. I replaced it myself and then it snapped again 3 months later and so on about every 3 months a hose snapped or disconnected and flooded my basemen. A few days ago the whole discharge pump mounting bracket exploded and flooded my basement yet again. I never thought it was this much of a problem and knew it was out of warranty so never attempted to contact Samsung. Now I am washer less and Samsung refused to admit there was a problem when I called and said they had no recorded data of any issues with my washer model. Which obviously is a lie considering there are about 4 years worth of complaints on this page alone. I will never buy another Samsung product for the rest of my life!

    I had bought Samsung products since the 90’s, DVD players, tv’s, phones, all great. So when it came time to get a new washer/dryer I had faith in them. MISTAKE! Top load model #WA400, absolute GARBAGE! Within 6 months had 2 drain motors installed, main board replaced, and for the last 6 months not one error free (dc) load. Machine is perfectly level, suspension rods are good, nobody knows whats wrong. All Samsung knows is that they won’t pay for it. I recently bought a new tv, phone for me and the wife and guess what? They are LG. They knew these designs were atrocious, defective and utter s**t. I, nor my family, will never purchase another Samsung product EVER! They wanted $600 to fix this clunker. Brilliant business strategy, assure that customer purchases competitors product.

    I’m in Australia and have had same problem with the smell, clothes not washed properly and am currently in my fourth month of being unwell and just diagnosed with COPD, also been battling a debilitating itch for many years however am now joining all the dots together and they are all pointing to my Samsung machine WF0754W7V!!! I will never purchase any Samsung product ever again and will go back to a top loading machine not a SAMSUNG though!

    SAMSUNG WF45H6300AG WASHER PURCHASED 2.27.16 REPLACED DRAIN PUMP 6.2.16 AFTER UNIT FLOODED AREA AND STOPPED TAKING IN WATER. REPAIR PEOPLE ORDERED PARTS AS SOON AS THEY HEARD WHAT HAPPENED; SEEMED ALMOST EXPECTED… 6.5.16 AREA FLOODED AGAIN. AWAITING CALL BACK FROM SAMSUNG.  MY MISTAKE IN BUYING SAMSUNG.  LOOKS LIKE THEY ALREADY HAD ONE CLASS ACTION SUIT WITH WASHERS.  DON’T BUY!!!!!!

    My top load washer wasnt even a year old and had to be replaced by Samsung. The new top load vrt washer constantly has a mildew smell. It retains water in it, not where I put the clothes. I always leave the washer door open but it doesnt prevent the horrible odor! Ive ran the pure cycle, Ive used bleach or vinegar to try and get rid of the smell but nothing works. I think it is because water is always in the area that spins. If I were to manually spin my washer you can hear a ton of water in it! The water is always in the machine. I paid a lot of money for both the washer and dryer and I regret my purchase every day! I will never buy or recommend Samung products again! Their refrigerators are horrible too!

    I have the Samsung front loader machine and dryer. I have had it with these machines! The smell of mold is atrocious! ( yes I do leave the door open, I have owned front loaders for about 8 years now and I have 3). This one is the worst!!! It rips apart my underwear and bras puts small holes in the bottom of my shirts! It has ripped apart my sheets! And yes I get the error message a lot! I am extremely disappointed with Samsung and will not ever recommend them to anyone

    Hello all my fellow duped Samsung owners of washers and dryers. My washer spins so hard plastic parts are falling off the machine. I sent in photos of the washer and the handles they say are not on the side of the machine. They are designed there but mine have been knocked out and are on the floor, and the dryer does not dry. I had this brought into my home on 8-6-2015. I can not get a service person to repair either appliance. I did get a refund of the total price verbally with a ticket number. However I still need the washer refunded. I can not use this machine. I warned them it spins so violently that if the stacking kit breaks it could knock off the dryer and kill someone. I however have a app on my phone and record all important conversations. I was advised they will contact me in 48 hours to do what?? I hardly could understand him. The call center is not in the USA no problem but there was a communication barrier. I really feel after seeing this class action law suit I am going to try to return this to Home Depot. maybe they will return it if I buy another set with them. I am afraid to use the washer after today. My dryer is stacked on the top of the washer it is gas. Attached to a gas line. BOOOOMMM would go my house and Family. NOT GOOD!!!!! 48 Hours are they serious ?????? OMG I wish I would have known. My clothes stink, My house shakes, it eats clothes, 58 minutes should be 58 not 27, my dryer just does what ever the heck it wants to but never heats up much. I think the song it plays gets stuck and is secretly laughing at all of us Samsung owners. lol JK but really. I just want to wash my clothes. it isn’t right Samsung QUIT MAKING THEM!!!!

    The washer smell is hurting the family,it smells like a dirty wet kitchen mop. I have try to use all the hints on the internet,nothing works.My washer is only a year old, i still have a warrenty on it ,but i guess it does not mean a thing to them.this is mold and is very dangerous to our health,thats why i have been sick for so long.I have been breathing in the rotten mold smell.Please help,thank you.

    You described the smell perfectly,I have tried every thing to get rid of that smell.What do the samsung people say about it? The machine is only one year old,i have the warrenty on it,but i guess it doesn!t help solve the problem.
