Roundup class action lawsuits overview: 

  • Who: Stephanie Holsapple, Carl Bergeson and the estate of Allen Winters filed separate class action lawsuits against Monsanto Company. 
  • Why: Holsapple, Bergeson and the Winters estate are the latest to make claims against Monsanto accusing the company of negligence by selling Roundup weedkiller they argue was responsible for their cancer diagnosis due to it containing the allegedly carcinogenic chemical glyphosate. 
  • Where: The class action lawsuits were filed in Minnesota and Mississippi federal courts.

Plaintiffs filed a trio of class action lawsuits against Monsanto Company by consumers claiming it was negligent in its manufacturing, marketing and selling of Roundup weedkiller. 

Stephanie Holsapple, Carl Bergeson,and the estate of Allen Winters separately claim Monsanto harmed consumers by selling Roundup containing the chemical glyphosate as an active ingredient. 

The plaintiffs argue glyphosate is a cancer-causing chemical that is “defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce.” 

Further, Holsapple, Bergeson,and the Winters estate claim Monsanto failed to properly warn consumers about the dangers associated with using Roundup weedkiller. 

“Plaintiff’s injuries, like those striking thousands of similarly situated victims across the country, were avoidable,” the Roundup class actions state. 

Holsapple claims exposure to Roundup and glyphosate has been linked to a number of cancers, including Non-Hodgkin’s lymphoma, Hodgkin’s lymphoma, multiple myeloma and soft tissue sarcoma.

Further, Holsapple argues Monsanto has known about the cancer-causing effects of its Roundup weedkiller since the “early to mid-1980s,” including from human and animal studies. 

“Defendant either knew or should have known of the material representations it was making regarding the safety and relative utility of Roundup products,” Holsapple’s Roundup class action states. 

Holsapple also claims that, due to Monsanto allegedly knowing about the dangers associated with Roundup, it fraudulently misrepresented the weedkiller product and concealed its dangers from the public. 

“Upon information and belief, Defendant did design, sell, advertise, manufacture and/or distribute Roundup with full knowledge of its dangerous and defective nature,” the lawsuit states. 

Roundup class actions claim Monsanto’s weedkiller causes cancer

The Winters estate argues years of exposure to Roundup weedkiller caused Allen Winters to develop lymphoma, which he ultimately passed away from in January 2022. 

Holsapple and Bergeson, meanwhile, claim their exposure to Roundup weedkiller manufactured and sold by Monsanto led to their diagnoses of Non-Hodgkin’s lymphoma and lymphoma, respectively. 

Their claims include fraud, negligence, failure to warn, breach of implied warranties and violation of Mississippi’s Unfair Trade Practices and Consumer Protection Law, among other things. 

The plaintiffs each demand a jury trial and request compensatory damages, with Bergeson and the Winters estate also requesting statutory damages, for themselves and all class members. 

Meanwhile, a number of class action lawsuits against Monsanto over its manufacture and sale of Roundup weedkiller products continue working their way through courts around the United States

Complaints and class action settlements all center around Roundup containing glyphosate with some also noting that the weedkiller product contains the surfactant POEA.

Monsanto Company, Case No. 0:22-cv-01529, in the U.S. District Court for the District of Minnesota.
