$14M Costco sales emails class action settlement

Costco agreed to a $14 million class action settlement to resolve claims it sent misleading emails to Washington residents.

The Costco settlement benefits individuals who received a commercial sales email message from Costco between June 2, 2021, and July 7, 2026, who were Washington residents at the time of receipt.

Costco is a wholesale retailer that sells groceries, home goods, electronics and more. The company has locations around the country, including in Washington.

According to a class action lawsuit, Costco violated Washington’s Commercial Electronic Mail Act (CEMA) by sending misleading sales emails to consumers. The plaintiff in the case says that Costco’s sales email contained subject lines that advertised time-limited promotions — despite the company knowing it would extend these promotions.

The Costco class action lawsuit claims that these sales emails violated CEMA, which protects consumers from misleading commercial emails. Under CEMA, consumers can seek $500 for each email sent in violation of the law.

Costco has not admitted any wrongdoing but agreed to a $14 million class action settlement to resolve the allegations.

Under the terms of the Costco settlement, class members can receive an equal share of the net settlement fund. Exact payment amounts will vary depending on the number of participating class members and the amount deducted for costs, such as attorneys’ fees.

Class members can choose to receive their settlement payment as a check, PayPal, Venmo or another electronic payment method.

Any funds from uncashed or undeliverable payments may be used for a second distribution or donated to the Legal Foundation of Washington.

The deadline for exclusion and objection is Aug. 24, 2026.

The final approval hearing for the Costco settlement is scheduled for Oct. 2, 2026.

To receive settlement benefits, class members must submit a valid claim form by Aug. 24, 2026.
