Bayer Pharmaceuticals is facing serious product liability charges in an Essure lawsuit, filed by multiple women.
The Essure problems described in the Essure lawsuit stemmed from unexpected menstrual bleeding to dangerous ectopic pregnancies.
One dozen women have joined this Essure lawsuit, including two women filing conjointly with their spouses who are also affected by the unexpected consequences of Essure complications.
Alleged Essure side effects have reportedly caused some of these women to not only become pregnant, but to suffer ectopic pregnancies in which the baby develops outside the uterus.
It is important to note that each of these women had the Essure birth control device implanted to prevent pregnancy, and to permanently shut off their fertility functions.
Essure Lawsuit Allegations
The Essure birth control is currently the only form of female sterilization on the market, aside from traditional tubal ligation. Many women opt for the Essure birth control to avoid the complicated surgery, eliminating almost all hospital recovery time.
Pennsylvania plaintiff Yolanda B. was one of these women, who had Essure implanted in January 2007. Even though the device worked well for over five years, Yolanda discovered there were many Essure problems when she learned she was pregnant in October 2015.
According to the Essure lawsuit, Yolanda had developed a cervical ectopic pregnancy and had to get a drug induced abortion due to how dangerous the pregnancy was to her and the baby.
Other claimants who suffered severe Essure problems include Nevada plaintiff Jason L. and his wife Crystal G.
After having the Essure birth control implanted in September 2013, Crystal also learned she was pregnant three years after the Essure procedure. Crystal is currently in her second trimester, while she and her husband are worried over how the Essure side effects may affect her and their unborn baby.
Yolanda and Crystal were upset to learn of their unexpected pregnancies, also reporting other Essure complications including menstrual bleeding and severe pain.
A number of the women in this Essure lawsuit claim similar injuries, as the Essure complications also led them to suffer unexpected pain, bleeding, and the need for further medical procedures.
Overview of Essure Complications
The Essure birth control was approved by the FDA in 2002, and was originally manufactured by Conceptus Inc.
After Bayer HealthCare acquired the rights to the Essure birth control, they began marketing it as a safe and effective alternative to tubal ligation.
Essure is composed of three metal coils that are directly implanted the fallopian tubes by a medical professional. The tissue in the fallopian tubes will eventually swell, ultimately preventing sperm to egg fertilization.
However, a number of women have reported severe Essure complications, with ectopic pregnancies and organ perforation being some of the most dangerous. Since its approval, over 4,500 adverse Essure side effects have been reported to the FDA.
This Essure Lawsuit is Case No. 2:16-cv-02154 in the U.S. District Court for the Eastern District of Pennsylvania.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
