Omaha steaks class action settlementTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Omaha Steaks of violating the Telephone Consumer Protection Act.

According to reader comments and posts on the Top Class ActionsFacebook page, Class Members who submitted timely and valid claims for the Omaha Steaks class action settlement began receiving checks worth as much as $41.22 on Dec. 15, 2016.

The Omaha Steaks class action settlement resolves allegations that food company placed calls to consumers’ cell phones using an automatic telephone dialing system in violation of the TCPA.

According to the class action lawsuit, Omaha Steaks sent thousands of robocalls to consumers without their prior express written consent.

The TCPA is a federal law that prohibits companies from sending texts, faxes or robocalls to consumers without their permission. Telemarketers who violate the TCPA may be required to pay between $500 and $1,500 per violation.

Omaha Steaks denied the allegations but agreed to pay up to $5.2 million to settle the class action and avoid the cost and risk of further litigation.

Class Members included all individuals who received a robocall from Omaha Steaks on their cell phone sometime between Dec. 9, 2009 and Dec. 17, 2013.

The deadline to file a claim for the Omaha TCPA settlement passed on Aug. 12, 2016.

    I received a gift card for approx 27 bucks. Glad I get those circulars that has packages for 35 bucks so I won’t owe to much more for a lot of goodies.

    i opted for the giftcard because it was SUPPOSED to be higher value than the cash payout. So it is less? WHAT A JOKE. bait and switch. DISHONEST. they lied.

    I would be interested in filing a class action suit against KCC. Many here think they cheat the consumers filing for claims. Lack of denial letters and the inability to contact them after the checks are mailed to find out why a claim was denied and to contest the denial seems patently dishonest. If they toss claims just to receive more money and make it impossible to contest. that would be fraudulent behavior.

    I only received a $27.48 Reward Card. A lot of good it will do. There is nothing on-line that you can get that is lower than $14.99. Then you add shipping ($15,88) and then you add the $27.48, you still owe money.

    They try to find a Omaha Steak store anywhere in Los Angeles. There are 3. Impossible to get too for $27.48. You waste that much in gas trying to find store.
