Noisy Nintendo Wii U Controller Class Action Lawsuit
By Sarah Pierce
Nintendo’s new Wii U controllers are faulty, causing them to rattle noisily under normal use and distract players, according to a new class action lawsuit filed in California.
Plaintiff Joubin Rahimi alleges in the class action lawsuit that he purchased Nintendo’s new Wii U system for $350 in November and noticed that it sounded like a loose piece was rattling around inside the controller. Rahimi returned the defective equipment twice for an identical system, but each new Wii controller had the “same disturbing rattling,” according to his class action lawsuit.
Rahimi says he contacted Nintendo of America Inc. about the noisy Wii U controller and was told the company was aware of the problem, but did nothing — and continues to do nothing — to resolve the situation.
“Nintendo merely advised Rahimi that if he held down all the buttons of the GamePad controller at the same time (an abnormal action to take while using the video game controller) the rattling would be diminished,” the Wii controller class action lawsuit says.
Rahimi is seeking an injunction and actual damages for a proposed class of other Nintendo Wii U video game system owners that experienced the same problem.
The Nintendo Wii U Controller Class Action Lawsuit case is Joubin Rahimi v. Nintendo of America Inc., Case No. 12-cv-06351, in the U.S. District Court for the Northern District of California. The plaintiff is represented by Roy A. Katriel of the Katriel Law Firm.
