Nissan A federal class action lawsuit claims Nissan knowingly sold certain Maxima, Altima and Quest vehicles equipped with defective automatic transmissions that can suddenly and unexpectedly fail while being driven.

According to the Nissan transmission defect class action lawsuit, the allegedly defective transmissions are present in 2004-2006 Nissan Maximas, 2005-2006 Nissan Altimas, and 2004-2007 Nissan Quests. The class action lawsuit claims Nissan knew, or should have known, since at least 2004 that the automatic transmissions in these vehicles are defective, which can cause them to break down prematurely; experience transmission slips, delayed shifts, and acceleration surging; and suffer mechanical failure.

Rather than alerting consumers about this safety hazard and offering to repair the vehicles, “Nissan has concealed this problem from its customers at the time of purchase or lease and thereafter,” the class action lawsuit states. Not only has this put consumers in danger, but it has also allowed Nissan to profit from the defect by selling replacement parts to Class Members.

The Nissan transmission defect class action lawsuit is brought on behalf of all U.S. consumers who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicle equipped with an automatic transmission. It is seeking class certification, damages, disgorgement of profits, and injunctive relief.

The case is Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Case No. 12-cv-00332, U.S. District Court, Central District of California, Western Division.

UPDATE: This case was voluntarily dismissed by the plaintiff on June 29, 2012. Details behind the dismissal were not indicated in court documents.

    Had the same “jerking” problem with my 2005 Maxima last year.. cost me $4k to have it replaced with a rebuilt one! Nissan Customer Service was a JOKE.. If its not under warranty forget about them helping you at all! No matter how much you complain. Their Reps are sleazeballs.

    Been having problems with my wive’s 2005 Altima SE-R. Makes a loud noise from the transmission. Just got the letter for lawsuit and already signed up. Another reason why we should of bought a Ford. Bye the wa, my car is a 2003 cobra 460 rwhp. Runs like a champ. Buy American cars.

    I had this Same problem I have a 2005 altima When I took it in they didn’t see anything. Next time they said leave it over night to see in the morning. Same thing. Nothing was wrong.. Right before the warranty was over I took it in they wanted me to pay out of pocket put I told them it was still under warranty. They changed it for free but I still have the same problem. When I asked the guy if he had heard of any similar problems he said no. What a lie. Next car will be a Hyundai sonata

    I have the same problem with my 2006 Nissan Altima 2.5s. This transmission causes the car to slip, jerk and shift hard. I’ll never buy another “Nissan” again! My next car will be a Toyota!

    I have a 2006 maxima and i’m having the same transmission problem.The mechanic informed me that nissan knows about this valve body problem.He informed me also that the same company makes transmission for volkswagon and those vehicle have the same problem,the difference is volkswagon fixes the situation.My situation with my 2006 maxima started at 4500 miles I contacted the dealer and they stated they can’t do anything unless I paid them $3700 .I need to get in on that class action lawsuit.

    I have a 2004 Nissan Maxima and have been going through the same problems for almost 2 years and its getting so bad I know one day this car isn’t going to move. I regret ever buying a Nissan which I will never do again.

    I have a 2005 Nissan Maxima and I have the same problem that I’ve seen and heard described everywhere else. Transmission starts to slip and jerk… hangs in 5th gear sometimes.

    Hello everyone,

    If you want to be added to this class action lawsuit simply call the legal firm that is handling the case. I just got off the phone with them. They are Intiative Legal Group based in Los Angeles, CA. They were very helpful and they asked some questions about your vehicle.

    I have an 2005Maxima which two yrs ago i had to get my transmission rebuilt. the the repairs cost me over 3,000. now my car wnt pass inspection due to catalyst and evap system failure. i hve 78,634 miles on it. Nissan tld me to drive it 150mls more to get it open. i found out at my job by a mechanic tht my catalyst is cover under 80,000mles!!!!! sooooo Nissan is trying to be slick so i wld hve to pay for a new catalyst. theyre Bullshit!!!!! BBB needs to gve them an F for fake,failure,fraud,.
