According to a recent report, Xarelto lawsuits have reached 3,000 in number.
These claims are filed by patients who experienced adverse blood thinner side effects, particularly dangerous internal bleeding events.
Xarelto internal bleeding cases have been filed nationwide and are now pending in a federal multidistrict litigation (MDL), under U.S. District Judge Eldon Fallon of the Eastern District of Louisiana.
Currently there are at least 2,835 Xarelto lawsuits pending in the federal court system, with several hundred additional claims pending in Pennsylvania and other states, all similarly alleging that Xarelto manufacturers Bayer Pharmaceuticals and Johnson & Johnson, had failed to adequately inform them and the medical community of the risk of internal bleeding.
In each of the Xarelto lawsuits, claimants indicate they suffered serious blood thinner side effects and uncontrollable internal bleeding injuries as result of using the anticoagulant drug. The claims also state that the manufacturers knew how severe the risks were, but had omitted the information on the Xarelto warning label.
At this time, Xarelto has no approved reversal agent for internal bleeding injuries and requires hospital intervention to stop the effects.
Xarelto (Rivaroxoaban) is a new generation blood thinner approved by the DA in 2011, to be an alternative treatment product to patients suffering from atrial fibrillation and prevent stroke.
This drug was meant to directly compete with the original blood thinner, Warfarin, and fellow new blood thinner Pradaxa. It was released as a joint effort between Bayer Pharmaceuticals and Johnson & Johnson, and quickly overtook the anticoagulant market.
However soon after its release, patients started reporting serious blood thinner side effects including internal bleeding events like gastrointestinal hemorrhaging.
Overview of Xarelto Bleeding Complications
Unlike Warfarin, Xarelto and other new blood thinners are prescribed in one dose and do not require frequent adjustments like their predecessor.
When Xarelto was released it was advertised to be more efficient and convenient than Warfarin, which led to it becoming a popular choice for patients. However, the large number of prescriptions resulted in a large number of dangerous blood thinner side effects reports.
Xarelto Lawsuits
These federal court cases have been consolidated into an Xarelto MDL, to serve to the parties’ conveniences, avoid duplicate discovery, and conflicting ruling from different judges.
Recently, a status conference was held for the Xarelto lawsuits on Feb. 03, 2016, with Judge Fallon indicating that the plaintiffs’ attorneys that were appointed last year for leadership roles are being discharged from their positions.
During the coordinated pretrial proceedings, a discovery process will begin to select a small group of bellwether Xarelto lawsuits will be selected to go to trial. The claims are expected to be presented to juries between February 2017 and May 2017.
While the outcome of these claims are not binding on other Xarelto lawsuits, it will most likely influence the outcome of potential settlement claims. Xarelto patients who suffered internal bleeding, may be eligible to file a legal claim against the manufacturing companies.
