Mirena IUD lawsuitA Wisconsin woman has filed a Mirena IUD lawsuit against Bayer Healthcare Pharmaceuticals Inc. alleging that the intrauterine device perforated her uterus and required surgical removal.

Plaintiff Brooklyn Horn reportedly suffered from Mirena IUD spontaneous migration side effects that required surgery and continuing treatment as well as “permanent bodily impairment,” she claims in her Mirena IUD lawsuit. The injury reportedly occurred about two years after the initial insertion in 2009, three years before the usual end of the five year period that the birth control device is supposed to last.

Horn argues in her Mirena IUD class action lawsuit that Bayer continues to fail to warn about the possibility that the device could perforate or migrate from the uterus even if it is properly implanted by a doctor. Further, the label “also describes perforation as an “uncommon” event, despite the fact that there are numerous women who have suffered” from those problems, as seen in several Mirena IUD lawsuits.

Similar Mirena lawsuits have been filed in addition to tens of thousands of adverse event reports filed with the U.S. Food and Drug Administration (FDA) over problems with Bayer’s intrauterine device. In this Mirena IUD lawsuit, it is noted that the drug maker had to issue corrective advertising after the FDA said Bayer made inaccurate claims about its benefits while minimizing risks.

Instead, the Mirena IUD lawsuit alleges that Bayer failed to include the information regarding adverse events “despite the fact that evidence existed that the use of [the intrauterine device] was dangerous” and could lead to Mirena IUD spontaneous migration side effects. Worse, the possibility of it happening without warning puts the millions of women who have used the birth control device at risk.

The Mirena IUD lawsuit is Brooklyn Horn v. Bayer Healthcare Pharmaceuticals Inc., Case No. 14-cv-290, in the U.S. District Court for the Western District of Wisconsin.
