cell-phone-bill-feesTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Midland Credit Management Inc. of violating federal law by placing unwanted calls to consumers on their cell phones without obtaining permission first.

According to comments and posts on the Top Class Actions Facebook page,Class Members who filed valid claims for the Midland Credit Management class action settlement began receiving checks worth as much as $23.81 on May 30, 2017.

The class action settlement resolves allegations that Midland Funding, Midland Credit Management and Encore Capital Group violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to call consumers in an effort to collect on an unpaid debt.

The plaintiffs claim they received numerous harassing phone calls by the creditors before filing this TCPA class action lawsuit.

Under the terms of the settlement, MCM agreed to pay $15 million to partially pay-off Class Members’ unpaid debts. Individuals with no debt received a cash payout.

Midland Credit Management denied the allegations but agreed to settle the class action to avoid further litigation. 

Class Members included all U.S. residents “who were called on a cellular telephone by Defendants or their subsidiaries, affiliates or related companies (other than calls made by Asset Acceptance LLC, Atlantic Credit & Finance, Inc. or Propel Financial Services) in connection with the collection of an alleged debt using a dialer or by artificial or prerecorded voice message without prior express consent during the period from November 2, 2006 through August 31, 2014.”

The deadline to file a claim for the MCM class action settlement passed on April 12, 2016.

    Hello I received a letter a while back telling me my debt was cleared no check or anything just saying that I no longer owe the money my hard credit report it says the debt is paid but now they have filed judgement to try and get the money is there any way to get another letter to show proof that this lawsuit cleared my debt because I have lost the other letter

    What if I got a check for almost $5,000? Is this legit? Why did I get so much more than others? I haven’t cashed the check yet.

      Tommy: A $5,000 check would not be from this class action. If you filed a valid claim, you were supposed to get either a check for about $23, or a notice that a similar small amount of debt was forgiven. However many people got neither, and it is not clear why.
