Lipozene and MetaboUp False Advertising Class Action Lawsuit

By Matt O’Donnell

LipozeneMetaboUpObesity Research Institute has been hit with a false advertising class action lawsuit for making claims “too good to be true” about its diet drugs/supplements, Lipozene and MataboUp.

According to the class action lawsuit, Obesity Research Institute uses bold fonts and “official looking seals” on its product packaging that lead consumers to believe that Lipozene and MataboUp diet pills are clinically proven to “reduce pounds of body fat and weight without a change in lifestyle.” The products also misleadingly state that not only users will lose weight merely by taking the product, but that 78% of each pound lost will be pure body fat.

“In reality, the too good to be true claims made by Obesity Research Institute are just that and the Defendant is and has been misrepresenting the effectiveness of its weight loss products to the general public in order to reap windfall profits,” the Lipozene and MataboUp class action lawsuit states.

As a result, consumers have been unfairly duped into paying $29.95 a bottle for diet pills that do not provide the advertising benefits “whatsoever.”

The MataboUp and Lipozene class action lawsuit is brought on behalf of all persons, nationwide, who purchased Obesity Research Institute’s diet products, including a sub-class of California residents who purchased the products. It is seeking class certification, damages and restitution for alleged violations of the Consumers Legal Remedies Act, false advertising, unfair competition, breach of express warranty, and breach of implied warranty.

    1. Rosa says:

I think that the only way you will see a difference is if you change your workout plan and stop eating after 6 and if you are real.ly hungry then eat a piece of grilled chicken or a little saled to sustain your appitate

  3. mary cardet says:

advertised at 3.95. Nothing said on ad that it had caffeine in it. I thought I was having a heart attack. Threw it away. Then a charge went through for
89.41 They will not refund the money. I am filing complaints with bbb. consumer affairs and FTC

  4. Denise J Wheeler says:

I have been on lipozene before and it has helped me with eating less and I buy mine at wal-mart for $19.98. And has anyone taken the metaboup yet and can they be taken with the lipozene.

    1. michell says:

I’ve been taking lipozene for about 3 weeks I’ve changed my diet and I go to the gym 5 times a week and ive seen so many results in my body. I have not gotten on a scale yet but the way my clothes are falling of off my butt I would say ive lost about 25 to 30 pounds. I just started taking metabo-up and boy does it give me energy. I;ve been bouncing off the walls. In order to see results you need to get off your butt and change your diet sitting on you ass eating a double cheese burger and taking lipozene are not going to make you lose weight.

      1. RamBam says:

Totally agree! I started juicing and stopped eating at night. The metalboUP really helps. Lost 15 lbs in 3 weeks

    2. Tina McGriff says:

Yes, you can take MetaboUP with Lipozene. I take it and it gives me energy to get going.

      1. diamond says:

    3. Jessie says:

Yes the metabo up plus can be taken with the lipozene. It’s recommended to take it once a day 30 minutes before exercising.

  5. cOOLJQ says:

You people make me mad! OF COURSE you are not going to lose weight eating like a pig and taking these pills! You have to eat healthy and take them. They “HELP” weight loss, not cause weight loss.

    1. dirk says:

how about some exercise and spending the 29.95 on healthy food instead of this garbage you fools LOLOL!!!

    2. RamBam says:

Loved your comment…you are absolutely right. I gained 20 lbs thru menopause….and eating late at night.
I got the pills with the free MetalboUP and lost 15 in 3 wks. The only bummer was not sleeping well because I was so active…. Nothing works ALONE

  6. Spikes says:

  7. virginia says:

I have tried this drug and its done nothing i still have my birth weight . I am up set and it didn’t help myself estime. I feel fat and ugly

    1. Rosalie Martinez says:

I’am giving it a try ..you have to really want to lose the weight..and at least do some walking and try to eat right its not easy ..but so far I really like the Metabo Up ..it helps gets me moving during the day

    2. Kerry says:

I know this is old but I just wanted to say that I know how you feel. I had my son 4 months ago & I weigh more now than I did when he was born because of PPD. I feel fat & ugly. My husband says he doesn’t care how much I weigh, but I know I look nothing like the woman he married & I feel ashamed that I let myself get like this. It’s depressing & being depressed makes it all the more difficult to lose weight. I bought lipozene but haven’t tried it yet. After reading this I don’t have high expectations. I hope that you were able to feel better about yourself regardless of the efficacy of lipozene.

      1. Liz says:

It actually worked for you?Which ones did you take?
