A new class action lawsuit accuses JetBlue Airways of using consumer data to set ticket prices.
Plaintiff Andrew Phillips filed the class action complaint against JetBlue Airways on April 22 in New York federal court, alleging violations of federal, state and common law.
According to the class action lawsuit, JetBlue used consumer data to set ticket prices — a practice known as “dynamic surveillance pricing.”
The lawsuit alleges that JetBlue collected and used the data without adequate consent to set prices based on consumer behavior.
Phillips claims that JetBlue’s website, JetBlue.com, uses tracking technology to collect personal information from consumers, which is then used to adjust ticket prices dynamically.
He argues this practice violates consumers’ privacy rights and results in higher prices for airline tickets.
JetBlue allegedly shared consumer data with third parties
Phillips claims JetBlue shares consumer data with third parties, such as FullStory Inc., a behavioral analytics platform, and PROS Holdings Inc., which uses algorithms to set pricing in real time based on buyer behavior.
The plaintiff alleges JetBlue’s privacy policy does not adequately disclose the use of consumer data for dynamic pricing or the sharing of data with third parties.
The class action lawsuit alleges JetBlue’s actions have drawn criticism from Congress and federal regulatory authorities, prompting further action on the alleged practice.
Phillips seeks to represent anyone in the United States who used JetBlue’s website or mobile app and had their data shared with third parties.
He is suing for alleged violations of the Electronic Communications Privacy Act, New York’s Deceptive Trade Practices Act and New York’s Unlawful Selling Practices Act, and seeks class certification, damages, attorneys’ fees and costs and a jury trial.
In 2024, consumers filed a class action lawsuit against Delta Air Lines Inc. over allegations it unlawfully shared their personal information with Meta Platforms.
