
Palm Beach Tan has agreed to a $2.5 million class action settlement to resolve claims it violated federal telemarketing laws with unsolicited text messages.
The Palm Beach Tan settlement benefits individuals who received a Palm Beach Tan text message after sending an inbound text message stop request between June 19, 2019, and July 5, 2026.
According to claims made in the class action lawsuit resolved by the settlement, Palm Beach Tan sent unsolicited telemarketing text messages to consumers even after they requested to stop receiving these messages. Plaintiffs in the case say these unsolicited text messages violated the federal Telephone Consumer Protection Act (TCPA).
Palm Beach Tan is a tanning salon with locations across the country.
Palm Beach Tan has not admitted any wrongdoing but agreed to this $2.5 million class action settlement to resolve the TCPA lawsuit.
Under the terms of the Palm Beach Tan settlement, class members can receive a cash payment based on the number of post-stop messages they received. Each class member will receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating class members and the amount remaining in the fund after deductions.
Class members who received one post-stop message can receive up to $1,500 from the settlement.
The deadline for exclusion and objection is Oct. 4, 2026.
The final approval hearing for the Palm Beach Tan settlement is scheduled for Dec. 29, 2026.
To receive settlement benefits, class members must submit a valid claim form by Oct. 4, 2026.
