Vivint class action lawsuitVivint mandatory training class action lawsuit lawyers have launched an investigation into whether or not the company adequately compensated employees who underwent seminars, lectures or other meetings in order to continue on their jobs.

The Department of Labor has established a four-step procedure for determining whether or not such activities must be considered as part of a worker’s hourly pay. In order for it to be uncompensated, “it is outside normal, it is voluntary, not job related, and no other work is concurrently performed,” according to a fact sheet discussing hours worked under the Fair Labor Standards Act (FLSA).

Just as companies cannot ask employees to clock out for breaks or before their shift is done, any mandatory training that does not meet all of those four standards must also be included in a worker’s pay. It is believed that Vivint may have possibly not done so in certain instances regarding its training. It is also possible that travel costs may have been incurred above and beyond those accounted for by the FLSA and Department of Labor regulations.

Vivint is a company with international operations that began as a home security company in 1997. It has expanded to provide home automation related to home security as well as solar panel installation in California and other states.

However, the company has also been linked to unpaid training class action lawsuits before. It was accused of robocalling cellular phones in violation of the Telephone Consumer Protection Act in two separate Vivint class action lawsuits, and the company has also either been charged or settled lawsuits regarding deceptive marketing practices or fined for code violations by 14 states.

The potential Vivint lawsuits would be similar to unpaid wage class action lawsuits regarding misclassification of workers as either exempt or subject to a tipped wage when they are not performing those kinds of duties. However, many people are only becoming aware more recently of the full scope of their rights as workers, including pay for mandatory training.

    I was parking my car with my foot on the brake when all of a sudden the car sped forward and crashed into a building. The car was totaled. As a result of this accident which was not my fault — my foot was on the brake — I have lost my driver’s license. This was clearly a case of sudden unintended acceleration — my foot was on the brake the whole time this was happening. If my seat belt wasn’t on I could have been killed. It was a horrible thing that happened.

    I am sick of FedEx miss delivering me packages and basically not taking any responsibility. This has happened 3 times and each time the packages were not recovered and even though the companies either refunded or sent the order again a few items could not be replaced. I was told that the independent route owner is notified but that is about it. My comment back is when will these route owners train or hire people who know the difference between even and odd sides of the road. I was told to call the police since it was a neighbor who kept the items. So they know where they went and could not recover the items. I also had a FedEx Express driver leave very expensive medication on my car window and the items that have been left out in the open weather when our porch is covered and about a 10 ft walk for the driver.

    We have a pre-paid lease with SunRun with certain 20-year performance guarantees and promises that they will maintain our system in good working order. They also pay us a set amount for lost power when the system is not working but this amount does not cover the loss of solar energy at today’s rates. They did service the panels for a few years but have since become very difficult to work with. 4 of our 10 panels are not working. About 6 months ago after repeated requests they sent a service rep out to look at the panels. He indicated that we needed new parts that he would have to order. We have not been contacted again to complete the repair. We have contacted Sunrun repeatedly over the last 6 months and get the same answer, that they will continue working on it and will contact us, but no one ever contacts us back.

      Hello,
      I am having the same problem here in Florida with Sunrun Solor. My system has been installed for more than 4 months and no one has made an effort to come out and turn it on or get it inspected to use. I finally did get it inspected and it passed now I can’t get them to come out and turn it on and when they did bother to return my calls I was promised a $1000.00 gift card and an extra battery for whole house power for when the power goes off and that has not happened. I was also promised $249.00 credit on my bill and that hasn’t happened either. I need and want to start a class action law suit against Sunrun solor and need one of the attorneys to contact me about this problem. Thank you!

    Side note I have made no purchases of any kind past this point as I do not trust them anymore to hold up to date card information as they might start charging me for something I didn’t authorize or I might not be able to cancel a subscription

    Information incident 1
    I got the game pass for console 14 day free trial I could not cancel it since I couldn’t sign into Microsoft online as I couldn’t remember my password at the time and if I remember correctly there was no option to cancel on Xbox or they were trying to have me go online to cancel but I didn’t know my password.
    So after 18 months my mom notices it looking through bills and goes to the bank after talking to me about since I told her I couldn’t find a way to cancel it. It can be seen as a failed payment.

    Information Incident 2
    I had a 1 month subscription starting around the same time I got the game pass for console and since my mom was paying for it she wanted the $10 a month option as it would be easier to make that payment but at the time stated above I canceled it because of a few reasons 1 I was gonna start paying for my own Xbox live 2 my mom wouldn’t have to pay $10 a month $120 a year and I could get a 1 year subscription for $60 and 3 I could renew my subscription on my own time especially since I would be paying for it and I started using my Xbox less. At the time stated above I entered a store bought year membership fast forward to the end of that and at the time stated above unauthorized 1 month subscription at $10 a month started a day before my year membership ended. Since it was unauthorized I had no idea they were being made so I didn’t cancel it on my Xbox as I wasn’t really using it as stated about I was starting to use my Xbox less. So fast forward to the time stated above my mom notices these payments and goes through the bank to cancel rather than me do it on my console since I had no idea nor did I authorize these payments. She later talked to me about and that’s how I found out. These payments could’ve gone on forever… so you can again at the time stated above see payment failed

    Subscriptions
    The subscription are not as easy to cancel as they are to sign up for at least for the game pass for console at the time and the Xbox live subscription payments were unauthorized nor did I have any knowledge of them and they started a day before my year subscription should have ended.

    Controller information
    Also side note I know they settled this in court somewhat but I have a wireless controller not under warranty that works perfectly fine except it can’t connect to the console unless I plug it in no matter what I try…. It’s a wireless controller it should be able to connect especially since it works just fine plugged in… bottom line if I would’ve know this would happen I wouldn’t have bought a $60 controller that’s wireless and have to buy batteries for it unless plugged in which it has to be now since it can’t connect no matter what I do and the controller didnt come with a cord so I had to find a usb c cord in a drawer that’s a foot or two long… Instead I would’ve bought the $30 wired controller for half the price if I knew I’d be getting a wired controller down the line from my wireless controller and the wired controller cord would be significantly longer than the cord I’m using. I’ve never had this happen before I have owned an Xbox 360 with multiple controllers and I have an Xbox one with 1 wired controller I bought when I bought the console that eventually stopped working cause of the cord and then a wireless one I bought that is having these issues before and after their updates and everything else they told me to try hasn’t worked. So I am stuck with a $60 controller plugged in with a 2 foot cord out of drawer when I should’ve just bought a wired one instead but how could I know this controller would work and then one day not be able to connect and have to be plugged for it work.

    I’m sorry for posting this twice but my lack of writing capabilities and proof reading I missed a key error during time frame incident 2 it should be seen as failed payment not canceled payment when talking about 12/25/2020

    ok im here on a faulty hp printer modle thats still being sold.. i got this printer 2 months ago it is a hp deskjet 2755e. i have nothing but issues in the 2 months form it kicking its slef off the network to not wanting to print and worse! when i tell it to pause printing cause its messed up a page and i need to redo it it kepps printing! unless i cancle the whole job. even then that sometimes does not work. it also loves to just kick out pages with nothing printed on them in multiple sucession. now lets get into the insant ink protion of this. im signed up with the highest they got but my issue is this im loosing valuable pages due to this faulty printers malfunctions by not stopping the print when its told to or when it does misprint a page and i cant stop it it keeps going. so ive lost around close to 300 pages ill never get back on my plan they counted as printed but was either miss printed or just kicked out pages with nothing printed on them. ive been round and round with hp over this. also they keep sending me inlk!!! its liek every time it malfunctions it send them a notice saying inks low when its not. also have recently ran into a issue with this printer not telling me the ink is low and yet again continues to print once i notice the ink is low..because the pages are printing lighter than they should be.. and it just will not stop when told to. by any means throught teh printer spool ect. ive contacted hp a number oof times about this issue they are sending me a new one. wich i told them i did not want the same modle because all the issues with this one.. but refused to swap out the modle for a different one. ive looked on line and im not the only person having issues with this particular printer! soem ppl are having the same issues. heck to even get it to proint is a fight to get it started! so i think something should be done about them selling this faulty modle and refusing to replace it with a diferent modle or even stop selling this obviously fault modle of printer.

    I purchased my 2015 Chevrolet Camaro 2 years ago unaware that the engine formed holes after 100,000 miles! Moritz Chevrolet did not inform me at the time of sale. So now, not only is my warranty expired but new parts are required which doesn’t go lower than 9,500! No one should be obligated to pay for- or overlook bad manufacturing.

    Bari Leather Furniture – was charged $5k then they filed bankruptcy and I never received any of the leather furniture I bought. They are supposedly still in business but I cannot get my money back and I’m sure there are many others in the same situation as I am when they filed for bankruptcy.
