Vivint class action lawsuitVivint mandatory training class action lawsuit lawyers have launched an investigation into whether or not the company adequately compensated employees who underwent seminars, lectures or other meetings in order to continue on their jobs.

The Department of Labor has established a four-step procedure for determining whether or not such activities must be considered as part of a worker’s hourly pay. In order for it to be uncompensated, “it is outside normal, it is voluntary, not job related, and no other work is concurrently performed,” according to a fact sheet discussing hours worked under the Fair Labor Standards Act (FLSA).

Just as companies cannot ask employees to clock out for breaks or before their shift is done, any mandatory training that does not meet all of those four standards must also be included in a worker’s pay. It is believed that Vivint may have possibly not done so in certain instances regarding its training. It is also possible that travel costs may have been incurred above and beyond those accounted for by the FLSA and Department of Labor regulations.

Vivint is a company with international operations that began as a home security company in 1997. It has expanded to provide home automation related to home security as well as solar panel installation in California and other states.

However, the company has also been linked to unpaid training class action lawsuits before. It was accused of robocalling cellular phones in violation of the Telephone Consumer Protection Act in two separate Vivint class action lawsuits, and the company has also either been charged or settled lawsuits regarding deceptive marketing practices or fined for code violations by 14 states.

The potential Vivint lawsuits would be similar to unpaid wage class action lawsuits regarding misclassification of workers as either exempt or subject to a tipped wage when they are not performing those kinds of duties. However, many people are only becoming aware more recently of the full scope of their rights as workers, including pay for mandatory training.

    I am interested in pursuing a class suit against EZPass MD for neglegence, mail fraud false advertising. I’ve had a transponder since approximately 2015 and ever since the entire transportation authority switched to automatic billing (instead of having tool booths), I’ve been receiving citations for tolls in MD when my transponder account was funded. I’ve responded to the citations with a letter and a copy of my account showing the funds available, only to later receive the citation with administrative costs attached. Again, I’ve responded to the (second) citation with the first letter and account statement attached. There is a several hour hold when attempting to settle the matter over the phone, and at this point I’m awaiting a court date. Because the overhead tolls generated the citations, I also did not receive the toll at a 25% discount, which is a benefit of having a transponder. I’ve researched this and others are having the same issues as I am with their transponders not being charged in MD, the wait on the phone, and the accelerated administrative fees. Some people have talked to their local news stations and those interviews are on the internet. All of this applies to Maryland only because I travelled through PA and DE during these same time frames; and my transponder triggered my account to be debited for the tolls in those states.

    I want to file a class action lawsuit against BB&T. My husband was receiving monthly checks which were direct deposited from a work injury. These checks came in every month and for over a year 2013 BB&T charged us for overdrafts. They never told us they were holding the checks…but after months…they continued holding the checks. BB&T took every penny of his checks because of their fees. That’s totally wrong!!!

    I want to join a class action suit against Extended Stay America. They have a hidden/obscured “advance pay” policy that allows them to keep your full payment even if you cancel prior to reservation. They robbed me of over $1500.

    I started a business and had a PO Box as my address. Google took my personal info from opening a google account. But Google took it upon themself and put my home address because they don’t advertise PO Box’s . My neighbors found out I was running a escort service , and called police because they thought it was running out of my home were I pay home association . Wasn’t a pretty site when the police banged down my door . Has Google ever put your home address for your business?

    I have two 2009 Chevrolet Impalas both of them, when the weather gets hot the electric door locks do not work. O one I have replaced the door locks three times and the other twice. the one that I have replaced three times are starting not to work again with the hot weather coming on. On both Impalas The AC/Heater actuators start clicking when you get in the car. I have replaced the actuatorss several times

    Do one on the billing fraud waste management does day to day. Those people are double and tripple charging people, also charging people 10.00 MORE to pay by check.

    When you cancel and are told your paid in full, they send you more bills and pretend you own back bills even though you were told months before your paid in full.

    3rd generation Dodge Ram trucks have a known problem with the exhaust manifold bolts breaking off causing expensive repairs to be needed. I have a 2016 Dodge Ram with low mileage (66,000 miles on it) and the passenger side exhaust manifold bolts broke off and had to be replaced. I was charged approximately $900.00 for the repairs. Dodge refused to pay for the repairs even though they have known about this problem for years.

    I live in frederick md..i used the salon pas pain patches and it give me a blister only after 1 hour .i called the company but they said that it didnt cause it but i know it did .i seen it and i have pictures.what can i do to make sure that people know about this product and what it can do to you

      Hi, I also have had same issues with using the product and just like you I was also told that it’s not caused by their products and obviously gotten nowhere with them…
