Vivint class action lawsuitVivint mandatory training class action lawsuit lawyers have launched an investigation into whether or not the company adequately compensated employees who underwent seminars, lectures or other meetings in order to continue on their jobs.

The Department of Labor has established a four-step procedure for determining whether or not such activities must be considered as part of a worker’s hourly pay. In order for it to be uncompensated, “it is outside normal, it is voluntary, not job related, and no other work is concurrently performed,” according to a fact sheet discussing hours worked under the Fair Labor Standards Act (FLSA).

Just as companies cannot ask employees to clock out for breaks or before their shift is done, any mandatory training that does not meet all of those four standards must also be included in a worker’s pay. It is believed that Vivint may have possibly not done so in certain instances regarding its training. It is also possible that travel costs may have been incurred above and beyond those accounted for by the FLSA and Department of Labor regulations.

Vivint is a company with international operations that began as a home security company in 1997. It has expanded to provide home automation related to home security as well as solar panel installation in California and other states.

However, the company has also been linked to unpaid training class action lawsuits before. It was accused of robocalling cellular phones in violation of the Telephone Consumer Protection Act in two separate Vivint class action lawsuits, and the company has also either been charged or settled lawsuits regarding deceptive marketing practices or fined for code violations by 14 states.

The potential Vivint lawsuits would be similar to unpaid wage class action lawsuits regarding misclassification of workers as either exempt or subject to a tipped wage when they are not performing those kinds of duties. However, many people are only becoming aware more recently of the full scope of their rights as workers, including pay for mandatory training.

    My name is paul and I fear for my life now on a daily basis I worked as a plant manager and threw out the years I had ta let afew people go for different reasons and bcause of that I have had individuals come to my home once in the middle of the night or early morning hours threatening me with guns acouple times I ask how did you find where I live and one person said all I had to do is put your name in my computer it showed him where I lived and even gave him a map to my front door what am I suppose ta do.now I feel I can never work a job where I’m above other people I stepped down for my existing job I know to some people that sound dumb but can you say that after you walk out to go to work get into your car start your engine and your waiting for your car to warm up when a person pushes a gun against your neck and says if you go to run it’ll b the last thing you do all I could think of is what will my wife my two kids my six grandkids do without a husband a father a grandfather I dout go to church but I believe I prayed that day in the early morning just bfor dawn I said lord please let me get threw this for my family and I promise I’ll never ever be a person that’s over eny one else I just want ta live ta b with my family and I think he listened and the guy that was behind me in my car that morning when the due was so thick you could cut it with a knife after I let him go that day from his job he hadn’t held a job down since and I apologized I’m sorry sir the order was handed down to me I was only doin my job and no longer did I get that out I heard my back door close all I could think of was thank you lord for giving me more time with my family I won’t waste it I promise.I’ve passed up afew great jobs only bcause I was gona have people under me and I’m sure there’s people out there that’s lost family bcause of the personal information on the Internet.can we at least fix it where our addresses are not on there and our family members names bcause it puts them in harms way also I’m just a little guy I understand that but I have people that loves me and there’s people I love very much it would kill me if one of my family members got hurt or killed bcause of my passed job or jobs thank you very much for giving me this opportunity to express my concern

    I would like to file class action lawsuit against the SBA targeted advance program. My business is in a targeted advance area an I was approved for a EIDL loan. I never received targeted advance email invite. I contacted them so many times just to get no response. Millions are experiencing this situation.

    Hi, in 2018, I took a left hand turn in Largo , Fl. In my lane, there was a completely stopped city garbaga truck in my lane. I signaled that i was going around it. Without any back up noises (as is the norm), this guy backed into me in the middle of the road (he said he was trying to do a uturn (on residential road two blocks long with 7 entry points). The police report was not allowed. That was the only statement i had from a 10 yr old boy that said the guy backed into me. The city claimed no liability and blamed me for negligence. No tickets were issued. If this had been ANYTHING other than a city vehicle, this case would have been over 2 yrs ago. Went thru 2 lawyers. I am 100 percent disabled with Bipolar Depression, PTSD, panic, and anxiety. Lawyer 2 had a “thing” against mental disabilities which did not surface until the lawsuit came closer. The city will not even let you sue for 6 months……..so I lost half a year. Over 25,000 in medical bills will become mine and I still have headaches. Lawyer 2 prepped me for deposition on a Friday, then the following Monday, cancelled the depositions and filed for motion to withdraw due to irreconcilable differences. He offered me a totally illegal settlement……..in an email, which i declined. There was no mediation even involved and the city claimed no negligence. He did not even send me a legal proposal. My phychiatrist wrote a letter to the court stating that if they allowed him to withdraw my health would be affected. The judge let him withdraw anyway. My health was affected. I lost my pt job…….from July up until beginning of Oct, I did not work. Could not work. I now work pt but cannot be around people and am petrified to drive. From what I have researched……….no one wins against the city. I cannot be the only one this has happened to……….the court system failed me allowing him to withdraw……did they not also violate my civil rights under the ADA? They sent me a letter telling me I had to go pro se if i could not find a lawyer to take over. No lawyer will take a case against the city from 2018 once it hit 2021. Seems to me like they dragged it out just to hit their 4 year mark that would not allow me to sue.

      How do you suffer from all those issues from a car backing into you? Did you suffer physical injuries? How badly was your car damaged? It seems like all of your cases were thrown out because they lacked merit and seemed frivolous.

    I have been overcharged/double charged overdraft fees with my bank every pay period.Thats twice a month. Their solution for me was not to pay all my bills at once and keep a record of what I spend because what they have pending on their side may not be what I see on mine.

      I purchased a living room sectional from Brandsmart USA. I paid over $2,000 for it cash. After 4mos. the middle recliner broke. I called the company to notify them my couch was broken, I was immediately directed to schedule an appoint,ent for repair with the vendor Fast Furniture which repaired the items under warranty. I went in person to the store & spoke with a service manager which gave me the runaround. I visited the store a total of 6 times and my warranty runs out on 01/06/ 2022. And, my couch is still broken. How do I sue them to get my money back or make the proper repairs???

    Received letter from Catholic retirement fund…underfunded etc. I retired from Benilde-St. Margaret’s High School in Mn. I was an Accountant. I instructed new employees as to benefits. We were NEVER made aware of the fact that the fund had opted out of the federal pension fund insurance! The retirement was an inducement along with the other benefits to accept lower wages for the long term benefits. This is, in my opinion, terribly fraudulent, immoral and deceitful. This devastating to those of us that depend on our retirement income. You cannot conceive how I feel misleading these employees!

    My Nissan Versa transmission failed. The car is only 7 years old. Nissan published an extended warranty on the defective CVT, but now refuses to honor it. No deadline was issued, but their associates continue to say it is past the deadline.

    Total Safety US, Inc. out of Houston Texas is doing the same thing with 360 Safety Training courses that you have to do it on your time just to keep your job and you’re not getting paid for it. It takes anywhere from 10 to 14 hours to complete and that’s if the website is working. I have emails to prove it. Also travel time that was not paid flying, travel to airport and back from Saudi Arabia. This happen 2/2013
