SH Group and Sterling Infosystems agreed to pay $630,000 to resolve claims that they violated the Fair Credit Reporting Act (FCRA) when supplying and using consumer reports.

The settlement benefits individuals who were the subject of a consumer report provided by Sterling Infosystems to Kiosite between Dec. 9, 2019, and Nov. 6, 2022, and whose Sterling consumer reports concerned SH Group job applicants.

The settlement also benefits an SH Group subclass made up of class members who were the subject of a consumer report procured by SH Group from Kiosite for employment purposes between 2016 and 2019.

Plaintiffs in the class action lawsuit claim Sterling Infosystems failed to comply with the FCRA when providing consumer reports to Kiosite LLC. SH Group allegedly committed additional FCRA violations when using the same reports for employment purposes.

Sterling Infosystems is a background check company. SH Group is a hotel company that operates hotels and resorts worldwide.

SH Group and Sterling Infosystems haven’t admitted wrongdoing but agreed to a $630,000 settlement to resolve the class action lawsuit.

Under the settlement terms, eligible class members can receive a check for at least $100 but could receive at least $200 if they are also members of the SH Group subclass.

The deadline for exclusion and objection is May 20, 2024.

The final approval hearing for the settlement is scheduled for May 22, 2024.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.

Individuals who were the subject of a consumer report provided by Sterling Infosystems to Kiosite between Dec. 9, 2019, and Nov. 6, 2022, and whose Sterling consumer reports concerned SH Group job applicants.
