Hyundai lease pricing class action lawsuit overview:
- Who: Elsie Metcalfe filed a class action lawsuit against Hyundai Capital America.
- Why: Metcalfe claims Hyundai Capital America unlawfully marks up the end purchase price of its leased vehicles.
- Where: The class action lawsuit was filed in Rhode Island federal court.
Hyundai Capital America charges consumers who choose to buy out their leased vehicles more than what the lease-end purchase price should be, a new class action lawsuit alleges.
Plaintiff Elsi Metcalfe claims Hyundai has been aware “for years” that it allegedly allows its Hyundai and Kia dealers to mark up the purchase price of its leased vehicles.
Metcalfe argues Hyundai Lease Titling Trust, as the owner of the leased vehicles and their lease holder; its servicer, Hyundai Capital America; and their agent Grieco Hyundai LLC all have an “obligation to honor the lease end purchase price.”
“If Hyundai Lease Titling Trust and Hyundai Capital America choose to have Hyundai and Kia dealers handle lease-end transactions on their behalf, they have the obligation to cause their dealer-agents to honor the lease end purchase price,” the Hyundai class action states.
Hyundai class action alleges breach of contract, violation of Consumer Leasing Act
Metcalfe wants to represent a nationwide class and Rhode Island subclass of consumers who leased a vehicle held by Hyundai Trust Leasing Service or were serviced by Hyundai Capital America and charged more than the lease-end purchase price after deciding to buy the vehicle at the end of their lease.
Metcalfe claims Hyundai is guilty of unjust enrichment and breach of contract, among other things, and in violation of the Consumer Leasing Act and Rhode Island deceptive trade practices laws.
He demands a jury trial and requests declaratory and injunctive relief along with an award of appropriate damages for herself and all class members.
A separate class action lawsuit filed against Kia and Hyundai earlier this month claims the companies failed to equip their vehicles with engine immobilizers, making them more vulnerable to being stolen.

I paid for two Hyundai vehicles at the end of the lease. How do you know if you paid to much? I also have not received a Title for one of my vehicles. My account was closed in August of 2020, and the Title has not been sent. It has been over 7 months.
Add me I know I overpaid for my vehicle
