Update: 

  • A New Jersey federal judge dismissed class action claims alleging Ferrari and Robert Bosch manufactured and sold vehicles with defective motor vehicle components that affected their ability to brake properly.
  • On Oct. 25, U.S. District Judge John Michael Vazquez granted Ferrari North America’s bid to dismiss fraud and unjust enrichment claims brought against it by plaintiff Jeffrey Rose. 
  • The judge ruled that Rose failed to demonstrate the automaker had a duty to disclose the alleged problem.
  • His lawsuit claims that on two separate occasions he experienced a brake failure while driving his Ferrari vehicle. Rose argues that more than 23,000 Ferrari vehicles sold in the U.S. have been recalled since 2005 on account of faulty brake fluid reservoir caps.
  • Judge Vazquez says Rose has 30 days to file an amended claim.

Ferrari and Robert Bosch manufactured and sold vehicles with defective motor vehicle components that affected their ability to brake properly, a new class action lawsuit alleges. 

Plaintiff Jeffrey Rose claims that on two separate occasions he experienced a brake failure while driving his Ferrari vehicle.

Rose argues that more than 23,000 Ferrari vehicles sold in the U.S. have been recalled since 2005 on account of faulty brake fluid reservoir caps. 

The faulty caps—as determined in the recall reports—could lead to brake fluid leaking from the reservoir on account of inadequate pressure ventilation, according to the Ferrari class action. 

“Braking is critical to the safety of the driver, passengers within the vehicle, the drivers and occupants of other vehicles in proximity, and innocent bystanders,” states the Ferrari class action. 

Rose wants to represent a class of consumers who have sustained losses on account of allegedly defective Ferrari and Robert Bosch manufacturing. 

Ferrari, Robert Bosch accused of failing to disclose ‘potentially deadly’ defect

Rose claims Ferrari and Robert Bosch have failed to disclose the “potentially deadly” defect to consumers despite allegedly knowing about the issue from as far back as 2015.

“Defendants knew or should have known of the Defect from far earlier due to pre-production testing, failure mode analysis, and reports to authorized dealers and repair centers,” states the Ferrari class action. 

Further, Rose argues Ferrari and Robert Bosch have done nothing to repair or replace the allegedly defective vehicle braking systems.

Rose claims Ferrari is guilty of fraud by concealment, negligent misrepresentation, and unjust enrichment, and in violation of the New Jersey Consumer Fraud Act and Georgia’s Uniform Deceptive Trade Practices Act

Plaintiff is demanding a jury trial and requesting an award of compensatory, actual, treble, punitive, and/or statutory damages for himself and all class members.
