FCA US has agreed to pay up to $5 million to resolve a multistate class action lawsuit alleging that certain Jeep plug-in hybrid vehicles lose their electric driving capability in cold weather.
Lead plaintiff Jesse Crowell claims 2021โ23 Wrangler 4xe and 2022โ23 Grand Cherokee 4xe vehicles have a defective “Fuel and Oil Refresh Mode,” or FORM, that blocks electric-only and electric-assisted driving.
Although the owner’s manual said exiting FORM could take up to 20 minutes in cold weather, the vehicles stayed in the mode for months rather than minutes, the Jeep class action lawsuit claims.
The plaintiffs allege FCA US hid the limits of the vehicles’ electric driving, leaving owners without a key feature that set them apart from gas-only models.
FCA US has denied all of the allegations and maintains that FORM is and has been operating as designed at all times, the class action motion says.
The plaintiffs asked a federal judge on Oct. 26 to preliminarily approve the unopposed Jeep class action settlement. During discovery, FCA US produced more than 400,000 documents. The parties held mediation sessions on Nov. 18, 2025, and Feb. 23, 2026, before finalizing the deal on Oct. 16.
Jeep Wrangler 4xe owners could receive up $400 or more per vehicle
The settlement class includes anyone who bought or leased a model year 2021 Jeep Wrangler 4xe equipped with FORM in the District of Columbia or one of 29 “cold weather” states, such as New York, Michigan and Colorado. The class covers about 29,000 vehicles.
The settlement does not cover owners of 2022-23 Wrangler 4xe and Grand Cherokee 4xe vehicles or owners of 2021 Wrangler 4xe vehicles who live outside the cold-weather states. California plaintiffs have agreed to settle individually outside the $5 million fund.
Class members who swear under penalty of perjury that their vehicle was in FORM for more than 2.5 hours of operation can receive $400 per vehicle, split equally among co-owners.
Those who submit records of a complaint about exiting FORM to FCA US, a dealer or a service center can receive an extra $250 for one complaint or $350 for two or more. If claims exceed $5 million, only the extra complaint payments will be reduced.
Class members must mail a claim form within 60 days of the notice date, which falls 90 days after preliminary approval. Notices will be mailed directly to class members and will also flag software updates that optimize FORM.
FCA US is facing a separate class action lawsuit claiming it failed to disclose and adequately repair two defects in Jeep Wrangler 4xe and Jeep Grand Cherokee 4xe plug-in hybrid electric SUVs despite marketing them as โsafe, dependable, rugged, high-performing and emissions-friendly hybrid-electric vehicles.โ
