A new class action lawsuit alleges Honda sold Odyssey minivans with a defect that causes the airbags to deploy spontaneously without warning or a crash.

A group of class action plaintiffs filed the lawsuit against Honda Motor Co. Ltd., American Honda Motor Co. Inc. and Honda Development & Manufacturing of America LLC on May 13 in California federal court.

The lawsuit asserts the defect poses a safety risk to drivers and passengers and reduces the value of the vehicles. 

The plaintiffs allege Honda knew of the spontaneous deployments but hid them, even while recalling the same vehicles for other airbag defects.

The Honda airbag class action lawsuit claims the automaker violated consumer protection laws and warranty obligations in California, Florida, Georgia, Illinois, Indiana, Kentucky, Michigan, Nebraska, North Carolina, Ohio, Pennsylvania and Texas.

Lawsuit: Honda Odyssey airbags can deploy due to potholes or speed bumps

The Honda airbag defect can cause the side curtain and side thorax airbags to deploy without any collision, warning or dashboard indication, the Honda class action lawsuit says.

“When airbags deploy unexpectedly, occupants are subjected to explosive force, chemical fumes and loss of visibility,” the Honda class action lawsuit says.

The complaint alleges the airbags can deploy after the vehicle encounters a minor road surface irregularity, such as a pothole or speed bump, or even while driving on flat roads, slowing to a stop or refueling a stationary vehicle.

The plaintiffs say they would not have purchased their vehicles if they had known about the defect. They assert Honda has refused to cover the cost of repairs, which can range from $3,000 to $11,000, under warranty.

The group is seeking damages, restitution and injunctive relief to compensate for the diminished value of their vehicles, the cost of repairs, out-of-pocket expenses, loss of use and the harm caused by Honda’s concealment of the defect.

In another class action lawsuit, consumers allege Honda sold certain popular vehicles with serious design defects in the turbocharged engines, including the Honda Accord, Civic and CR-V.
