
GM class action lawsuit overview:

A new class action lawsuit alleges General Motors sold certain Chevrolet and GMC trucks, including the Chevy Silverado, with a defect that causes the rear sliding windows to be prone to water intrusion.
Plaintiff Filiberto Loza Gonzalez claims GM has refused to pay for repairs to the rear sliding windows unless the trucks are presented for repairs during the warranty period.
Gonzalez argues GM knew the trucks contained the defect, which he claims can cause safety-related damage, including mold growth and electrical failure.
“Electrical failure can result in [the] vehicles being unsafe to drive, due to the failures of the electrical and mechanical systems, rendering [them] unfit for safe operation in the roadway,” the GM class action lawsuit says.
Gonzalez wants to represent a California class of consumers who purchased or leased a model year 2019 or 2020 Chevrolet Silverado or GMC Sierra truck that was first placed into service after Jan. 3, 2019.
Lawsuit: GM failed to disclose defect to consumers
Gonzalez claims GM has refused to disclose the defect to consumers and has failed to make any effort to protect them from the alleged safety problems.
“GM has published numerous technical service bulletins, advising its dealerships of several symptoms of the water intrusion defect,” the GM class action lawsuit says. “But GM has willfully, knowingly and wrongfully failed to disclose the existence of the water intrusion defect to consumers.”
Gonzalez claims GM is guilty of violating California’s Business and Professions Code and Consumers Legal Remedies Act.
He demands a jury trial and requests declaratory relief and an award of compensatory, exemplary and statutory damages for himself and all class members.
In another recent GM class action, a group of vehicle owners accused the company of selling a wide range of vehicles, including Chevrolet, GMC and Cadillac models, with defective 10-speed transmissions.
