General Motors PCV System Class Action Lawsuit Overview: 

  • Who: A group of General Motors vehicle owners have filed a class action lawsuit against the car manufacturer. 
  • Why: Vehicle owners claim GM fails to disclose an alleged defect with the positive crank ventilation system in certain vehicles it manufactures and sells. 
  • Where: The class action lawsuit was filed in Michigan federal court.

General Motors fails to disclose a defect with the positive crank ventilation system (PCV) in their vehicles’ internal combustion engines, a new class action lawsuit alleges. 

A group of GM vehicle owners claim the PCV systems in certain vehicles manufactured by the company are prone to “plugging and clogging” during cold weather. 

The vehicles affected by the alleged defect are GM’s 2010-2016 Buick Lacrosse, 2011-2017 Buick Regal, 2012-2017 Buick Verano, 2010-2015 Chevrolet Captiva, 2010-2017 Chevrolet Equinox, 2013-2014 Chevrolet Malibu and 2010-2017 GMC Terrain vehicles, according to the class action lawsuit. 

In the event a PCV system malfunctions, the owners argue the vehicle’s engine pressure can increase and lead to a rupture of its rear main seal, which they say can cause both catastrophic and permanent damage. 

GM, vehicle owners claim, sent out a “Diagnostic Tip” bulletin to dealers, but not to customers, in 2019 on account of the alleged clogging issue.

GM Class Action Claims Automaker Neither Recalled Affected Vehicles Nor Extended Warranties

Vehicle owners argue, meanwhile, that GM neither recalled the vehicles nor extended their warranties, instead electing only to “advised technicians to use a drill bit to clean out the clogged orifice.” 

Further, vehicle owners claim GM has known since “at least 1985” about the “PCV system’s vulnerability to cold weather and clogging” with owners arguing the company has repeatedly advised dealers on “how to fix” the issue.

“Despite this track record, GM continues to conceal this defect from consumers at the point of sale and continues to design, manufacture, distribute and sell hundreds of thousands of vehicles prone to this defect,” the class action lawsuit states. 

Vehicle owners claim GM is guilty of unjust enrichment and fraudulent concealment, among other things, and in violation of a number of state consumer protection acts. 

The vehicle owners want to represent a nationwide Class and Massachusetts, Michigan, Minnesota, New York and Wisconsin subclasses of all persons or entities who purchased or leased one or more of the affected GM vehicles.

Plaintiffs are demanding a jury trial and requesting injunctive relief along with costs, restitution and punitive, exemplary and treble damages for themselves and all class members. 

In related news, GM recalled more than 740,000 2010-2017 GMC Terrain vehicles last month over concerns the vehicles’ lower head lamps could present a glare issue due to a headlight housing defect.

    I purchased a 2014 Terrain that has this issue. I changed the pcv valve because there was white sludge stuff in the oil and on the dip stick. Before changing it out was making a horrible noise that went away for a little while after changing the PCV valve. My vehicle has 116,000 miles on it. How do we get this taken care of before the engine craps out on me?

    I have a 2010 72k Miles blown motor last year winter low oil , had 1200 miles to go before oil change .

    My son has a 2014 Equinox and the engine burned up due to a total loss of oil. there were no indications that this was about to happen. it will cost $3000.00 plus labor to replace this engine. He does not have the money currently to do this repair. Is there any open class action suits or payout that he could apply for?

    Add me please. I have a 2015 Chevy Cruze that has been costing me thousands of dollars after I’ve reached my 2nd year. When I say thousands of dollars so far it’s been $7,000 and I don’t understand how when I’m a local street driver and my car has never touched the highway or excessive driving for these expensive repairs to be needed

    I also have anothe issue, 2012 buick lacrosse with the cxs hiper front suspension struts, all the parts have been discontinued even by aftermarkets, summit racing, ac delco, rock auto, napa, autozone, etc, amazon… ebay, i have looked everywhere. there are no parts to be found, i contacted ac delco and the buick dealerships in fort worth tx and they have no solution. so am i supposed to drive with no shocks!!!! this needs to be included

    My 2017 Chevy Cruze has the same issues with PCV and now they saying I need a new engine costing $7-8,000 and I still owe $17,000 for the car…I would love to be added to this class action lawsuit

    Purchased 2013 Captiva from dealer they claimed it needed a new catalytic converter, they changed and nothing but problems, still haven’t figured out the issue throwing a different code every time we fix the previous one. Gave it a fresh oil change and started to sound like crap. My son still hasn’t been able to drive his car.

      I am the third owner of 2013 Cadillac escalade platinum with 77xxx at 114xxx the D.O.D failed and my lifter has collapsed. Wasn’t aware of this till I did my research. This has happened to hundreds if not thousands of consumers. It’s a very expensive fix that gm should be responsible for

    2014 Terrain…purchased 10 months ago. nothing but issues with this motor…basically need a new motor. I want in on this class action lawsuit as well! 23 year old, owe $12,500 on it…I can’t afford a new motor…this is shameful they haven’t recalled this motor!

      Just had a complete diagnostic check on it…I owe $12,000 the dealership says there is $11,000 worth of repairs to do…are you kidding me??? Please tell us how to get included in this class action lawsuit????

        And the hits keep coming, got a mechanic to put in the engine, but guess what, there are no engines available to purchase because there are soooo many people needing to replace their engine!

    2014 GMC Terrain. Interesting that after oil changes it seems to run a tad rough. Just thought it is normal for my miles.
    Radio and screen has shut off out of the blue then a few seconds it goes to the main screen.
    I’ve only received a recall yesterday on headlamps.
    Also I just was told that I am loosing turn by turn amongst other OnStar features as it has something to do with 2g will now need to be 5g in our Terrain???
    Is the manafucturer aware of this when making these vehicles??? There should be an upgrade done automatically you would think?
    Does anyone know what are all of the recalls are out that we need to be aware about?
