GM Transmission Shift Defect Class Action Lawsuit Overview:

  • Who: Six GM customers teamed up against the automobile giant. 
  • Why: The plaintiffs claim a defect in certain vehicles’ transmission that causes jerking and lurching in lower gears. They allege that GM knew about the defect for years but failed to disclose it. 
  • Where: The class action lawsuit was filed in Michigan federal court.

Six drivers filed a class action lawsuit alleging that several vehicles manufactured by GM are equipped with defective eight-speed transmissions and that GM concealed the defects from buyers for years.

The defect appears in first generation 8L90 and 8L45 transmissions built after Mar. 1, 2019, and “causes “harsh shifts” in lower gears, which can feel like jerking, lurching and/or hesitations,” according to court documents.

The class vehicles are 2019-2022 model year vehicles, designed, manufactured, marketed, distributed, sold, warranted and serviced by GM and equipped with GM’s eight-speed Hydra-Matic 8L90 transmission or Hydra-Matic 8L45 transmission. This includes the 2019-2022 Chevrolet Camaro, Colorado and Silverado; the 2019 Corvette; the 2019 Cadillac ATS, ATS-V, CTS, CT6 and CTS-V; and the 2019-2022 GMC Canyon and Sierra.

There are six named plaintiffs in the class action lawsuit against GM: Matthew Battle, Juan Castaneda, David Figueroa, Robert Gribble and Walter and Janice Helms. The plaintiffs seek to represent statewide classes that include all original purchasers or current owners of class vehicles who purchased the vehicles from authorized GM dealers in California, Michigan, New Jersey, Indiana and Washington. 

GM Class Action Alleges Automaker Ignored ‘Safety Hazard’ Since 2013

The shift defect detailed in the GM class action lawsuit presents a safety hazard because it affects “the driver’s ability to control the vehicle’s speed, acceleration and deceleration,” the complaint says. However, GM “has not… nor can it” fix the defect until the “planned deployment of a major redesign in MY23 models (Gen 2).” 

The plaintiffs argue that GM knew about the defect since 2013. They also allege that the defect is covered by GM warranties, but that GM’s authorized agents have denied customers meaningful remedies to the defect under warranty.

    Have a 2015 Cadillac Escalade ESV with 119k, transmission recently started exhibiting the same symptoms mentioned in this lawsuit. I was told by a reputable local mechanic that I would have to get this transmission replaced entirely, around $6500 before taxes!!

    2017 GMC Sierra Just replaced last year at 96000 miles. Dropped 8500$ on the replacement. Have all receipts and records if there a possibility to be contacted on this. 2nd Class action to be joining due to GM & on star.

    Our 2017 Silverado 1500 had these issues! One day it just wouldn’t go at the stop light, truck in drive and engine just revved. Check engine light came on. Towed it to a transmission shop and now needs to be rebuilt costing $6500

    Is it possible to get in on this? I have a 2019 GMC SIERRA 1500 SLE and some of the descriptions match exactly what my truck sometimes does with 46K miles on it. Dealership had their transmission tech test drive it 2 days in a row and said that everything was good and working normal. They did flush the transmission though.

    2014 silverado trans needed rebuild at 115000 because of torque converter started at 100000 never towed anything

    Own a 2019, began experiencing this issue at 6000 miles and repeated visits to dealership where I was told it was normal operating procedures but they would replace the transmission fluid. At approximately 36000 miles it started again and was told it was something totally unrelated to the transmission. Was in the dealership around 7 times between 36000 and 64000 miles. At 64000 when I returned to the dealership with the same issue was told it was suddenly torque converter but low and behold my warranty expired at 63000. Very convenient that this is suddenly the issue once it is no longer under warranty. How can I be part of this lawsuit?

    2017 chevrolet colorado transmission issues. Also the touch radio cluster system quit working at 21000 miles. Also I purchased extended warranty package from dealer for over $2100 and an extended maintenence plan for over $1800. They never covered anything unless I paid diagnostics on every part I wanted them to look at. My passenger air bag shows is not working. I only have about 32000 miles now and my warranty is expired. They never told me how to use the plan nor gave me info about what I bought. I asked them for a refund. Only to hear after it expired. It expired abs they won’t give me a refund. Over $3000 for nothing! My transmission is slipping, the touch screen does whatever it wants to do it has turned the volume up so loud once it nearly made me wreck! Scared me to death. Doesn’t respond to touch. I an not the only person having this problem! Again the dealer wouldn’t fix it unless I paid $185 diagnostics fee for each issue. Then the warranty maybe would’ve kicked in. This is wrong! I paid cash for my vehicle to boot. New Smyrna Chevrolet Florida

    I own a 2017 Chevy Silverado with transmission issues, It has been in the Chevy dealership since November of 2022 and it is April 27th 2023 and they still can not my truck fix. They allready install two transmissions 2 converter, a hrdraulic module, sprak plugs, injector, etc. After picking it up for the third time I still continue to t studdaring, inprpoper shifting, hard lock down shift, zlioping iof transmission when on highwat.
