Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    I paid 21,995 for a Ford F 150 almost had it paid off at 5,019. Then it lost oil pressure and part of the oil pump and a rocket arm was in the oil pan… locked the engine up! I then paid 7,800 for them to put a new motor in it which wasn’t a Ford machanic he was a jo blow off the street guy ! When I picked it up after they put this motor in the hood wasn’t on properly it almost fell on me and my wheel was about to come off! Hand tighten lug nuts my steering wheel controls won’t work the ac compressor quit we bought another and it still blows half warm air most the time ! They took my pay off and added the 7800 to it and refinanced it and I’ve been paying it back FORD HASNT HELPED DO SHIT !! THEY WONT EVEN GIVE ME A TRADE IN FOR IT

      I have same motor mine is a 09, & my RPM gauge is stuck on red line & blowing transmission fluid all over radiator. Not to mention constant changing of coil packs & spark plugs along with every other part under the hood

    Sure wish I’d had known about this I’m having to pay 3798.00 for another engine to be put in mine due too timing chain tensioner pulley malfunctioning I love my 2004 ford explorer and I’ve takening very good care of it

      This is the 2nd time in 3 years I have had to due the same with two timing chains in my expedition s. This time the timing chains went as I was going down the freeway so I am afraid my whole motor is shot. I lost oil pressure and everything.

    Have 07 f150 5.4 camfasers went out before warranty was over Jenkins ford said they would replace the front of the moter but wouldn’t replace engine.!! Truck ran for a mounth and it all happened again.

        Would love info If can join lawsuit. I have a 2004 5.4 and went to pass and almost had a head on collision due to not being about to pass cause power loss when accelerating

    Have 2014 f150 engine a loud knock on right bank. Purchased extended power train warranty with truck from dealer, and yet dealer said Ford is refusing to fix the problem. Customers are sold extended warranty under false pretenses. Ford had to be sued over their Trans so it’s time Ford owners stood up once again on failure to repair engine problems.

    I had a 2005 f150 with 5.4l Triton. Bought with 38k miles, at 74k started having problems. Took to dealers all they would say was, replace engine. Replace engine. Called ford. Excuses, excuses. Loved my truck. In the end i had to sell it for 1500 bucks! 15k truck. Sadly Ford has no honor or integrity. This was a well known issue with the truck. All of which Ford ignored. The Ford motor company owes me alot of money on this loss. Still to date I have not been able to recoup the loss of that truck. A little fyi for Ford. At the price you charge for new trucks and the fact that the company has zero conscience on selling defective vehicles right out the door to consumers to make that dollar. Drop the price by 10’s of thousands each vehicle. Plus throw in all the parts that are made overseas with subpar materials, the price needs to reflect these subpar parts costs. What happened to American Pride. Honor. And Integrity.

      I have a ’04 with the 5.4L and spent $4000 to replace the cam phasers. After two expeditions and one F150 I’ve switched to Ram.

        I have a 2007 Ford F150 Triton with the 5.43 valve SOHOC When I 1st got it truck waiting really good then all of a sudden it started having Is ticking and then it just kept getting worse replaced all the timing cleaned all the busted timing pieces out of pick up tube put the new milling oil pump in the high volume oil pump Had turned around and ended up replacing all of the plastic timing again Is the phasers for 2nd time Ford phasers Is the The variable vol timing Lifters rock arms The wiring was done horrible not enough ventilation So you’re wiring just takes a beating I replay so many pigtails and Positive and negative Wires it’s a never ending battle with this motor we all have the same issues through ridiculous for does not do nothing Pretty much all of us have the same The motor doesn’t stop with its constant breakdowns Extremely poor idol They don’t even make the wire harness that is for the main part of the engine That seems to be absolutely Most of the ones I’ve seen plus mine the wiring is just constantly having issues because corrosion or wire chafing So that’s not even available to purchase unless you go to a junkyard or you look online but most of them have the same issue the rotten As far as I’m concerned for new all this and they did nothing they should have to replace our motors If we’re all supposed to use genuine Ford parts why is it we’re going through so many genuine 4th parts Those phasers aren’t supposed to fall apart tell that to my timing The back plate Came apart and And smacked the plastic timing And broke it I’d like to know where the built for tough is It’d be an awesome motor if it was built correctly Is with reliable parts

    2008 ford f150 super cab 5.4 triton engine. This is the worst engine I have ever had, first computer had to be replaced, and now cam phasers ford was not sure wanted $3500 to look and see. Ford said could lead to motor replacement. My truck has 147,000 on it. Have had for trucks with 390 v8 and never had a problem. Ford wants 5,000 for the motor and 3500 to put it in. Computer was 900 and ford could not find a ford motor company computer to replace it. Had to get an after market with only a one year warranty. Ford only warranties the motor for three years. No new motors only rebuilt. It just gets worst. Never own another Ford.

    Rebuilt by ford long block 62,000 on motor cam shaft lifters shot pretty sad still selling that motor 3 year 100,000 mile warranty should be what ever comes last not first then they could be fixing this instead of me!

    43 thousand miles phasers went out…out of pocket ford dealer charged me an arm and leg. NOW 23 thousand later going out again.. FRICKEN JUNK I have bought 3 brand new ford f-250s over the past 18 years. JUNK. Some how we need to re-file a claim on these pricks….

      Eight year old gently used 67,000 mile E350 passenger van failed miserably. It was used as family vehicle and we bought it at 6 months old with 15,000 miles. Called Ford customer service talked to Kalisha Wise. She called the dealer who claimed it needed a new engine, to see if there were any programs to help defray the cost. Of course the service manager at Hiller Ford, Don Berka,said no programs were available. Gee you think! Now I’ve contacted or tried to contact her twice and she will not return e-mails or calls. My goal is to move it up the ladder in customer service. Any thing to help with the $7200.00 repair estimate. It’s actually a engine replacement with a new engine from Ford.

      I bought a 2004 F150 with a 5.4 triton engine . Biggest peice of shit I’ve ever owned. At about 40000 miles I put it in reverse and the reverse went out . Went with Aaaco transmission transmission still going. At 98000 miles I started it up and the timing chain caught a timing chain guide and pushed it up clear through the cast aluminum valve cover .the cam phasers keep the oil pressure up and the oil pressure keeps the tension on the timing chain. I had all new parts timing chain and gears cam phasers water pump , cam sensor ,crank sensor , Bets the whole works new . I heard Ford were supposed to
      Pay for 70% of a new engine . 2004 was the first year for the new 3 valve 5.4 Triton . Has any body else heard of this ? Last year I bought a new Chevy Silverado .y

        After you have that timing chain rebuilt did you have to do it ever again I have acquired an F-150 4×4 04 Triton 5.4 l engine that I am currently in the middle of replacing everything you just said the complete timing chain water pump oil pump all of it I bought the truck broke down it’s still rain I drove it from where I bought it to where it was going to get fixed and I have tore apart but like you said the timing chain guides when I pulled it all apart two of the guides were totally shattered in there I haven’t put it all back together yet but I’ve noticed that this engine has been apart before for the same reason I thought I was being crafty and I could fix this thing and the guy selling it was dumb but I turned out to be the dummy it looks like I paid $1,500 for the truck and another couple 100 for the kit and I’m doing all the work myself the shop wouldn’t touch it they just demanded I needed a new engine and I said they were crazy I didn’t read all this stuff before I bought it damn I’m a Chevy girl but I own three Fords and they’re all three broke down

          Look up fordtechmakuloco on YouTube he is a Ford guru and has a complete list of everything you wil need to replace to completely resolve this issue.

    Same problem with my ford f150 2005. At a little over 20,000 miles it started acting up. Ford didn’t want to take the blame so the lies and excuses started. My new truck sat in garage for over 6 months. Ford wouldn’t take blame we had to purchase a new motor out of pocket. Those 5.4 motors r junk its so sad. Im a Ford person this is the most horrible experience I’ve ever had with a Ford vehicle. Quick to sell u junk a lemon but not quick to fix their mistake. Still pains me and still paying out of pocket cause new motor ain’t no better. Its the 5.4 motors that r faulty.
