Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    I have 2008 Ford F150 with a 5.4 triton engine bot five years ago put five grand into the motor still runs the same stalls out. Say it needs new timing chain no mechanic will do. It got stuck paying five year loan plus repairs been sitting for five years

    We have a 07 Lariat f150 with 5.4. Our problems are with the cam phasers. We have spend over 1000 dollars on repairs just to be told that if we didn’t get the lock out kit it would happen again . We love our truck but just don’t know if we will be able to afford the repairs if it where happen again.

    I currently have a 2004 F150 5.4 3V, I am a female in my fifties and I have no help when it comes to truck problems, and I cannot afford to pay for repairs. My truck is experiencing every single problem described in this forum and now tonight, I cannot get my truck started. I am stranded and cannot afford a tow to a repair shop let alone the cost of repairs. I am supposed to start a new job in Wyoming in a month, how am I ever going to get there now?

    i have a 2006 f150 harley davidson nothing but problems with the plugs and how it runs terrable.ive spent over 3000 dollars on that motor.i want in on this lawsuit.

    2007 F150 with 5.4 3-valve Triton engine . No problems from new to about 130,000 MI. Towing a trailer to Albuquerque and part-way there, the cam phaser issue started. Made it to Albuquerque by baying it to find out it needed a transplant (new engine). $8,000 later, we are back on the road. No issues since. Now, I have a 2014 F150 with a 5.0 V7 (yes, lost a cylinder) and am facing another transplant. Found this site and hate that Ford did not stand up for their product by doing a recall or at least a relief program to help get these defective products off the road and that the judgment went against the consumers in a case of defective design. I am now hearing that the 3.5 V6 turbo is showing some similar issues. Time to switch brands.

    I have an 07 F250 with a 5.4 in it. I was not notified of the Cass action against Ford for this engine and uts issues.
    Mine has suffered from spark plug blow out to a faulty oil pump.
    Engine still runs, but has and emergency shut off in the event the oil pump fails to work.
    Needless to say, I’m without the use of my truck. I am also concerned that this may have had lead to issues with my transmission because I have had to park my truck.
    Now the big question, because I was not notified of the class action and was infact left out of it, how do I get satisfaction for having a faulty engine?

    I have a 2007 Ford F-250 with the 5.4L 3Valve Triton engine. It cost a fortune to get the spark plugs changed. 6 of 8 broke off and had to have a special tool to remove them. I drive the truck less than 10,000 miles a year. I recently turned 120,000 miles on the truck. I have been noticing a power loss and slight noise in the engine. It has gotten worse over time and has really gotten worse recently to the point that I know something is wrong. I bought this truck new from a local Ford dealership and have been the only owner of the vehicle. I baby this truck and always have. I am religious on my service schedule and only do the highest of quality service parts and fluids. This truck was supposed to last many many years without any major issues. I know things happen but at 120,000 miles actually less than that because it started a while ago is ridiculous. Now I find a lawsuit after I research what the problem is caused by. I was told the timing chains a phaser guides and other parts had to be replaced. I was told not to drive the truck or the engine would be damaged beyond repair. Now I am stuck without a truck to use to pull a trailer for my work to earn an income. Ford customer service said there is nothing they can do. The rep said she made the final decisions and there was nothing available for me as I had to listen to puppies bark in the background during the entire conversation and listen to her say she has no boss or supervisor that she has the power granted by Ford to make those decisions. I explained to her that I have spent well over $500,000 on Ford vehicles over the years and I find it hard to believe what she is telling me. She said she was ending the call if I had no other questions or concerns. I have a 2005 Ford Explorer with the 4.0L engine with a common timing chain issue that all Fords have from that period with the 4.0. How can Ford keep producing vehicles with these engines knowing they are garbage and not tell us and leave us as customers with the result of them failing. I never received anything saying there was a recall or a problem or even something saying it was an issue I would face and how to solve the problem before it happens. I have two engines requiring major work or complete replacement which is in the thousands of dollars and a lady representing Ford with her barking puppies in the background saying basically it’s not their problem.

    I have 2012 f150.twin terbo supercharge ecoboost xL it has 65,000 mile.and the motor locked up pretty sure the timing chain was the case will.ford replace my.motor.on them please let me know.

    Fraser engine remanufactures. They fix all the problems with this motor + 5year unlimited mile no fault warranty. 3,350.00 +shipping and core. Remanufactured not rebuilt…
