Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    2008 ford f150 lariat 4×4 with ticking due to engine problems like many other ford customers with the 5.4l 3v. Had the 2v engine in earlier models and this 3v is shit compared to the previous.

        Parts store has a removale tool for a 100 dollars to remove broken plugs. Next time run the motor to mid temp then shut off and remove the plugs that way. It heats the aluminum heads up and allow for easy removal.

    I DONT UNDERSTAND IT IVE GOT TWO FORD F150 S ONE IS A 2008 THE OTHER A 2009 I HAVE A SMALL BUSINESS WHERE I USE THESE TRUCK ON A DAILY BASIS THE 2008 HAS 157K THE 2009 HAS 120K THESE TRUCKS STAY LOADED WITH TOOLS BOTH ALSO HAVE LADDER RACKS BOTH HAVE THE 5.4 ENGINE I MUST BE DOING SOMETHNG RIGHT AS EITHER TRUCK HAS NEVER HAD A CAM PHASER PROBLEM IVE ALWAYS USED THE RECOMENDED MC FILTER AND 5 W 20 MTORCRAFT SEMI SYTHETIC OIL ALWAYS CHANGED OIL AT 4 K INTERVALS I NEVER CHANGED THE PLUGS I THE 2008 UNTIL IT HIT 150 K AND ONLY THEN BECAUSE IT STARTED GETTING BAD FUEL MILEAGE THE 2009 STILL HAS ORIGINAL PLUGS SO MY QUESTION WHAT AM I DOING RIGHT

      Our’s (2004 f-150) didn’t have a problem either until just a couple months ago with 250,XXX when out of nowhere the camshaft sensors when out and now the truck can’t even run.

      Well you are one of the lucky ones . my ford tech told me that only 1 in 10 of 5.4 L is a good one but if so many people are having problems with the same issue Ford should make it right it maybe the place were they out sourced the parts from maybe they cheap out on quality

    Same problems with my 2008 navigator 5.4 L. Hesitation with acceleration, problems with the electronics, idle noise when vehicle first starts driving. My mechanic told me the same thing that this should have been recalled. Having a cam phaser lockout kit put on now, was told that is a permanent solution to the problem. Otherwise problem will continue every few months, even when cam phaser are replaced.

    We have a 2010 Ford f150 Flex crew cab 5.4 l motor that just went out in now they expect us to pay $7000 for the motor So unfair not to the mechanic but to Ford company that did not recall these motors. I have always been a die hard Ford lover,at the age of 54 ive lost all trust in the Ford company.

      I just pd 9000$ for a 2006 Lincoln mark lt 4/4 it’s my first ford I ever got and I can say it’s the last one I will ever get it stalls don’t want to go dies out engine Knocks took it to Ford their mechanic did not even want to work on it he even told me Ford should have recalled all 5.4 liter engines it’s real sad they can get away with it and not fix the problem cuz people or just starting to realize that engine is trash and for new what they was doing and I think we all come together and make their ass pay

    2011 F-150 EcoBoost King Ranch. Had it in local ford service centre every 5000 km oil change and inspection. Engine Light was on at 92,000 km. I took it in and they found nothing wrong with it. I had it in June of 2017 engine light was on and they couldn’t fix or find the issues. It is now December 27, 2017 and I was informed the engine was being retarded with the timing chain and I need a new engine..

    2005 Lincoln navigator 5.4 same problems need new motor .also cost $500 to get spark plugs changed few months prior to cam phaser problems.

    My 05/06 ford f150 5.4l triton has been down due to cam phasers failure/timing for months. The more I research the more I see the same timing problem with everybody’s 5.4l triton. This issue is obviously unavoidable, therefore ford should not have won this case. Takin back to court with hundreds of unsatisfied 5.4l triton owners with the same cam phaser/timing issue; Ford’s loses and recalls the real issue.

        We should all come together cause the more I look in to it Ford new about this problem with the timing and a camshaft phasers I even have one of their head mechanics at a Ford dealership told me Ford should have recall these engines and people are just starting to get the problem with all the 5.4 s from 06 I have spent so much money on this truck from the spark plugs to sensors and now I have mechanics at Ford telling me I need a new engine but they won’t work on it unless I’ll buy all parts through them which to me they marked up on price cuz I found a lot cheaper engines elsewhere for new what they were doing so let’s get it going
