Ford Expedition, Lincoln Navigator class action overview: 

  • Who: Ford Motor Co. is being sued by owners and lessees of Ford Expeditions and Lincoln Navigators
  • Why: The customers say the cars are prone to catching fire

Ford Motor Co. sold Ford Expeditions and Lincoln Navigators that were dangerously defective and prone to catching fire both while driving, and while the vehicles are off, a new class action lawsuit alleges.  

Plaintiffs Jessica Stahlman, Jeremy Sessler and Ronald Smith filed the class action complaint against Ford Motor Co. on June 7 in a Michigan federal court, alleging breach of warranty and state consumer laws.

According to the complaint, model year 2021 Ford Expedition and Lincoln Navigator sport utility vehicles contain a defect in the engine compartment that can cause spontaneous fire while driving, while parked but on, and while parked and off.

The plaintiffs say while Ford knew or should have known of the fire risk prior to launching the vehicles, it did nothing to warn owners and lessees until very recently, only recalling the vehicles last month.

“And to this day, Ford has yet to provide a remedy for the defect or even suggest when it might be able to offer a remedy,” they allege. 

The plaintiffs say the defect exposes drivers to an unreasonable risk of accident, injury, death or property damage if their vehicle catches fire either while driving or while parked in a home or parking garage.

Sixteen fires so far

To date, there have been sixteen fires in a vehicle population of just 39,000, a number that Ford acknowledges is statistically significant, the lawsuit states. 

The fires have all occurred in the engine compartment of the vehicles, but Ford has yet to identify the root cause of these fires or the engine compartment component that is igniting, it says.

Instead, Ford is advising owners and lessees to park the vehicles away from homes and property.

“Ford offers no actual remedy for the Spontaneous Fire Defect and offers no reimbursement to Fire Defect Vehicle owners and lessees for out-of- pocket expenses, loss of use, and loss of value,” the lawsuit states. 

As a result, plaintiffs are looking to represent anyone who purchased or leased model year 2021 Ford Expedition or Lincoln Navigator vehicles. 

They are seeking certification of the class action lawsuit, restitution, damages, costs, disgorgement of profits, fees, costs and a jury trial.

    Yes, my 2021 Ford Expedition did catch fire while being driven on September 25, 2021. Luckily my daughter was driving behind us and alerted us to the flames. I do have some photos of the heat shield that burned. I traded it in because I did not feel safe with the proposed repairs.
