Bayer Healthcare is facing a massive joint Essure lawsuit with numerous women and their loved ones alleging they suffered serious Essure side effects.
Included in the Essure lawsuit is a husband and wife who are filing together, with the husband alleging his wife suffered permanent injuries resulting from Essure side effects.
Essure is a permanent, non-hormonal birth control product that is inserted through the vagina and is manufactured by Bayer Healthcare.
The Essure device consists of two flexible metal coils made of metal and polyester. During the procedure, one is placed in each fallopian tube. Once inside, the tissue of the fallopian tubes eventually swell and block the sperm to egg fertilization.
Even though this device has become very popular, a number of patients have reported serious Essure side effects like the patients in this lawsuit.
Florida couple Nichole and Kit C. allege the permanent birth control device injured Nichole soon after she had it implanted.
Nichole had the device implanted on Sept. 26, 2014, and began experiencing Essure side effects soon after. She started feeling severe menstrual and abdominal pain, as well as heavy bleeding and pain during intercourse.
In January 2015 tests were performed that confirmed the Essure device was in the correct position. In July 2015, Nichole underwent a sonogram that revealed a physiologic cyst in her left ovary.
Further medical testing indicated the development of the cyst could have been linked to Essure side effects.
Upon discovering the alleged association, Nichole opted to have the Essure device removed on Nov. 17, 2015. Nichole decided to file legal action against Bayer Healthcare after reviewing the Essure brochure and noticing it advertised the device’s convenience and did not adequately explain potential Essure complications.
Overview of Essure Side Effects and Lawsuit
The plaintiff conducted her own research on the Essure website and noticed the disparity between her experiences and how the website described the permanent birth control device.
Due to these Essure side effects, Nichole eventually had to have her fallopian tubes removed and still suffers from weight fluctuations, heavy bleeding, menstrual pain and abdominal pain.
Furthermore, her husband Kit is also joining the Essure lawsuit after the device allegedly impacted his marriage with his wife.
Not only are Nichole and Kit severely stressed from her condition, the Essure lawsuit indicates Nichole can no longer due household chores or play with their young children.
Kit states his wife is in too much pain to do any of those activities, and has since had to take over doing the household chores and other tasks as she is no longer able to perform them.
Kit and Nichole both insist that if she had known the severity of Essure side effects, she never would have opted for the permanent birth control device.
The entirety of Bayer’s advertisements for Essure surrounded its convenience and its short recovery time compared to traditional tubal ligation. Currently Essure is the only form of non surgical permanent birth control, which has since garnered thousands of injury complaints regarding the device.
Nichole points out that Bayer emphasize the device’s convenience but did not warn against the adverse effects that may come with it.
The Essure Lawsuit is Case No. 2:16-cv-02717-JHS, in the U.S. District Court of Eastern Pennsylvania.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
