Just 6 dog foodRachael Ray Just 6 dog food is advertised with false statements that it has a “limited ingredient” list, according to a recent class action.

Plaintiff Erin Kirchenberg says she purchased Rachael Ray’s Just 6 dog food monthly between January 2018 and February 2020 because she wanted to feed her two dogs – Molly and Buddy – a limited ingredient lamb diet.

“When pet owners buy limited ingredient dog food, they usually do so to prevent a health issue or address a nutritional deficiency that their dog may be experiencing,” the Rachael Ray pet food class action notes. “And consumers generally must pay a premium price for specialized pet food formulations.”

Kirchenberg allegedly researched Just 6 products and its ingredient list, which led her to conclude that the products were a good option for her dogs. However, the representations and advertising she relied on were reportedly false.

Just 6 dog food products are represented as having a “limited ingredient” list which doesn’t include corn, wheat, soy, or beef. These advertisements are allegedly intended to appeal to dog owners whose pets suffer from allergies or other food reactions.

However, despite representations that the products have a “limited ingredient” list, Just 6 dog food reportedly contains “significant amounts” of corn, wheat, soy, or beef hidden in the product ingredient lists.

In addition to prominent statements that the food contains “no corn, wheat, soy or gluten ingredients” and “no . . . beef,” the Just 6 dog food packages allegedly contain an express warranty purportedly signed by Rachael Ray – a respected celebrity chef.

The statement reportedly includes a variety of promises, repeating other statements on the pet food packaging and reassuring consumers that Just 6 is “nothing but good, wholesome food.”

Kirchenberg says that she relied on these and other representations regarding Rachael Ray’s pet food and believed that the product would be a good fit for her dogs.

“At the time of her purchases, Plaintiff relied on Defendants’ factual representations about the ingredients in the Just 6 dog food, including those representations on the product label and those in publicly broadcast television commercials starring Rachael Ray,” the Rachael Ray pet food class action argues.

Consumers may be searching for food based on a “limited ingredient” diet recommendation from their veterinarian. This diet reportedly helps sensitive dogs avoid filler ingredients in lower quality food that can lead to adverse reactions.

Simply 6 dog food and natural foodKirchenberg argues that she and other consumers paid a premium price for Just 6 products based on representations that the products supported a “limited ingredient” diet.

The Rachael Ray pet food class action argues that, had Kirchenberg and other consumers known the truth about the Just 6 products, they would not have purchased the pet food or would have paid significantly less.

“Plaintiff did not receive the benefit of her bargain when she purchased Just 6 products that included ingredients that did not conform to the packaging representations and warranties made by Defendants,” notes the Rachael Ray pet food class action lawsuit.

“Had she been aware of the misrepresentations, she would have either not purchased Just 6 or would have paid less for it.”

Kirchenberg seeks to represent a Class of California consumers who purchased Just 6 Rachael Ray pet food for personal, family or household purposes.

The Just 6 class action includes claims of breach of express warranty, breach of implied warranty, and unjust enrichment, along with violations of the Magnuson-Moss Warranty Act, California Consumer Legal Remedies Act, California False Advertising Law, and California Unfair Competition Law.

On behalf of herself and the proposed Class, Kirchenberg seeks compensatory damages, statutory damages, punitive damages, restitution, disgorgement, interest, injunctive relief, court costs, and attorneys’ fees.

    Please add me. My pets were on this for over 6 yrs. My lab mix almost 11 now is very ill along with my purebred basset almost 13. If its to good to be true it normally is. Lost my 13 yr old purebred basset girl last March also to health issues that had developed from issues from dog food ingredients. They all have issues now that have developed from the ingredients that were not listed on the bag!!! I’m disgusted at this.
