Consumer advocates are looking into whether Fisher & Paykel Appliances might be recording phone calls without consent, in violation of California laws.
California protects its citizens’ privacy to an even greater extent than federal laws. Whether a phone call is inbound or outbound, recording phone calls without consent of all parties on the line is a violation of California’s privacy laws.
If a company recorded your phone call while you while you were in California, you should have been warned that the call was being recorded. You also should have had the opportunity to end the call without it being recorded, or the company could have violated your privacy rights.
Recording Phone Calls Without Consent
Many companies have paid hefty fines and multi-million dollar settlements for allegedly recording phone calls without consent. Even if the company itself is not based in California, the law may apply to the individual consumer if he or she was in California at the time the call was completed.
In addition to Fisher & Paykel, other companies are being investigated for possibly violating consumers’ privacy rights. These other companies include, but are not limited to:
- American Airlines: Lost Baggage, Cancelled Flight, Emergency Information Numbers
- AMF Bowling
- British Airways
- Czech Airlines
- Malaysia Airlines
- Miele
- Pei Wei Asian Diner
- TGI Friday’s
- 99 Cents Only Stores
These companies should not record phone calls with customers unless a clear warning has been given that the calls are being recorded. At that point, a customer who remains on the phone has given implied consent.
Businesses don’t have to have ill intent to be guilty of disobeying the law. Even if a company records calls as a means to judge their customer service representatives’ performance, the company is still in violation of California law if both parties do not give consent to the recording. No matter what the reason for the recording, it cannot be done in secret.
California’s Constitution considers the right to privacy to be an inalienable right. As technological advances have created new ways to record conversations and made it easier to invade someone’s privacy, California has enacted new laws to optimally protect its citizens.
Companies that violate California’s laws regarding the prevention of recording phone calls without consent can be subject to damages of $5,000 per violation or three times the amount of actual damages incurred.
If you have been in California where you have made or received a call from Fisher & Paykel or any other company that has recorded the phone call without your consent, you could benefit from speaking with a lawyer regarding your options for legal action.
