The son of a Georgia woman has filed a blood thinner lawsuit against drug manufacturers of Xarelto claiming that his mother’s death was due to the medication.
Plaintiff David W. has filed this blood thinner lawsuit on behalf of his mother, Ima W. who died as a result of taking Xarelto.
According to his blood thinner lawsuit, his mother “suffered an intra cerebral hemorrhage and was hospitalized, as a direct and proximate result of the unreasonably dangerous characteristics of the prescription drug Xarelto.”
Ima, David’s mother, died on Sept. 6, 2016. David claims that his mother “experienced physical pain, mental anguish, medical expenses, loss of enjoyment of life, and wrongful death as well as other economic and non-economic damages.”
David said that as a result of his mother’s death, he has experienced expenses including medical and funeral expenses as well as other economic and non-economic damages.
Is Xarelto Dangerous?
Xarelto is a blood thinning drug that is part of a newer generation of anticoagulants. It was developed in part to take the place of the established blood thinner used by doctors to reduce the risk of blood clots and strokes in at-risk patients. This older medication is warfarin.
Warfarin is effective, but requires frequent dose monitoring and a diet change for patients. Xarelto and other new blood thinners were marketed as superior to warfarin because they did not need the same amount of lifestyle changes and were touted as one-dose-fits-all.
However, as is the case with all blood thinners, Xarelto patients run the risk of developing uncontrollable bleeding events.
The blood thinner was approved in July 2011 by the U.S. Food and Drug Administration (FDA) to help prevent incidents of deep vein thrombosis and pulmonary embolism in those who have had lower extremity surgery, namely hip replacements. Later that year, Xarelto was given the go-ahead to treat patients who were at risk for stroke or systemic embolism.
But, before Xarelto had even been on the market for 12 months, there had been over one thousand serious adverse events reports filed with the FDA. Of these 1,080 adverse events reports, there were 65 fatalities. Each of these resports cited Xarelto uncontrollable bleeding issues.
Over 2,000 Xarelto bleeding event reports were filed with the FDA by the end of 2012 and, in total, 151 deaths.
Filing a Xarelto Blood Thinner Lawsuit
David’s blood thinner lawsuit on behalf of his deceased mother is joining Xarelto multidistrict litigation for the purpose of streamlining the cases. He is filing this Xarelto blood thinner lawsuit against Janssen Pharmaceuticals and Bayer HealthCare on many counts, including strict liability, manufacturing defect, design defect, failure to warn, negligence, breach of express warranty, breach of implied warranty, negligent misrepresentation, fraud and wrongful death.
This Blood Thinner Lawsuit is Case No. 2:18-cv-05225-EEF-MBN in the United States District Court of the Eastern District of Louisiana. It joins MDL No. 2592.
