Bayer Healthcare Pharmaceuticals is facing another Yaz Lawsuit, after four women ages 36 to 53 allegedly suffered extreme pain and complications from the prescription oral contraceptives Yaz, Yasmin, Ocella, and Gianvi.
The first plaintiff, Nevada resident Ewa B., reportedly began using Yaz in August 2010 and continued until until June 2012. Ewa was forced to stop using the Bayer contraceptive when she suffered a stroke at age 33, allegedly caused by her consumption of the oral contraceptive, according to the Yaz lawsuit.
Similarly, Nebraska plaintiff Nicole K. also discontinued her two year use of one of Bayer’s above named oral contraceptives when she suffered a deep vein thrombosis in June 2012, she claims in her Yasmin lawsuit. Nicole was also 33 years old at the time of the alleged Yasmin side effect.
Marian W., resident of Hawaii, was 51 when she reportedly suffered a pulmonary embolism in June 2012. According to court records, her sustained injuries were caused by her two year prolonged use of Yaz, Yasmin, Ocella and/or Gianvi.
Finally, Illinois resident Beth C. suffered a stroke in June 2012, which allegedly can be reasonably linked to her use of Yaz. Unlike the other three plaintiffs, Caron had been on the Bayer birth control for just over 6 months, the Yaz lawsuit states.
All plaintiffs allege in the Yaz lawsuit that they were “caused to sustain severe and permanent personal injuries, pain, suffering, and emotional distress,” as a result of Yaz complications allegedly caused by the oral contraceptive.
All four women are seeking compensation for past and future damages, which include payment for severe personal injuries sustained, health care and medical costs, and legal fees. They are also seeking punitive damages from Bayer, which they allege “demonstrated a complete disregard and reckless indifference for the safety and welfare of the general public and to the Plaintiffs[.]”
Overview of Yaz Birth Control
Bayer’s popular oral contraceptive Yaz was first introduced in the American pharmaceutical market in 2001. Yaz (and its related Bayer manufactured drugs Yasmin, Ocella, and Gianvi) birth control pills are estrogen and progestin based oral contraceptives. They are designed to suppress ovulation, fertilization, and implantation of a fertilized ovum in order to prevent pregnancy.
While Yasmin, Yaz, Ocella and Gianvi are marketed similarly to other oral contraceptives, these Bayer products contain drospirenone, a type of progestin not found in any other birth control in the United States. Because of this unique property, Bayer has strongly promoted their products with the claims that they provide “the same efficacy as other birth control pills in preventing pregnancy, but with additional benefits.”
However, on July 10, 2003, the U.S. Food & Drug Administration (FDA) warned Bayer about their marketing claim that their drospirenone products were more effective and/or beneficial than other types of progestin-based birth controls. Soon after, the FDA issued a public warning stating, “the FDA is not aware of substantial evidence, of substantial clinical experience demonstrating that Yasmin is superior to other COCs or that the drospirenone in Yasmin is clinically beneficial. On the contrary, FDA is aware of the added clinical risks associated with drospirenone[.]”
Since then, many women have joined Yaz class action lawsuits after they allegedly suffered pain and harm from the oral contraceptive.
The Yaz Lawsuit is Case No. 3:14-cv-10336-DRH-PMF, in the U.S. District Court of the Southern District of Illinois.
