Allstate Homeowners Insurance Class Action Settlement

Allstate has reached a proposed class action lawsuit settlement over allegations it shortchanged customers who filed insurance claims for structural losses under their Allstate homeowners policies. If you submitted a claim for a structural loss under an Allstate homeowners insurance policy, you may be able to receive cash benefits from the proposed class action settlement. 
The Allstate class action settlement will resolve a class action lawsuit, titled Feely and Beeson v. Allstate County Mutual Insurance Company, that alleges Allstate did not properly pay general contractor’s overhead and profit (GCO&P) when adjusting claims for structural losses under homeowner’s insurance policies. 
“GCO&P” is an amount that may be charged by a general contractor for, among other things, supervising, scheduling and coordinating work and/or materials supplied by subcontractors in the course of repairing damage to a building or structure. A “Structural loss” means physical damage to a home, mobile or manufactured home, condo, farm/ranch or rental dwelling in the United States while covered by a homeowners insurance policy issued by Allstate.
You’re considered a class member of the Allstate homeowners insurance class action lawsuit settlement if you’ve ever been insured in the United States (except in Ohio or Pennsylvania) and submitted a claim for a covered loss. A covered loss is a structural loss that:
* occurred between September 6, 1996 and December 6, 2010;
* was determined to be covered by a homeowners insurance policy issued by Allstate; and
* resulted in a payment by Allstate between September 6, 1996 and December 6, 2010.
Under the Allstate class action lawsuit settlement, class members will be compensated for Allstate’s alleged failure to include an appropriate amount for GCO&P when it paid certain homeowners insurance claims for structural losses. The class action settlement also requires that, for a period of at least two years, Allstate engage in certain claim practices and make certain disclosures designed to help ensure that GCO&P is paid when appropriate.
The amount of money you can receive under the Allstate settlement will be between 10% and 17.5% of the amount previously paid by Allstate to you to complete the repairs, depending on the method by which the estimate was generated, excluding amounts paid for emergency remediation services, debris removal, licensed professionals, and any specialty contractor overhead and profit or GCO&P previously paid by Allstate.
To get your cash payment under the Allstate class action settlement, you must submit a valid claim form postmarked no later than June 6, 2011

    I just got off the phone with 2 of the 800 All State offices. No one seems to be aware of the Class Action Suit; the status, etc.. I wonder whether All State will EVER pay out what is due to persons who were a part of this suit

    I chose Allstate when I bought my home because they were the cheapest. Each year, the premium increased. Within five years, the premium had doubled, but I never filed a claim. I filed a roof claim in 2008 after wind damage. Allstate didn’t pay for it. I had wind damage the following year. They paid for it this time, but was nasty about it and paid the minimum. In 2011, a pipe burst after unthawing from a freeze. Luckily, we were home. The repairs cost nearly $15K, though. The water damaged the floors upstairs and the ceiling and floors downstairs. Allstate paid, but cancelled my insurance the following month. I couldn’t get insurance anywhere. The mortgage company forced insurance and my monthly payment increased as a result.

    I haven’t had any dealings with Allstate in almost 2 years. My former agent informed me, three days ago, of the class action settlement. I hadn’t heard anything before then. I began researching it, and stumbled upon this page. They know who they owe. Why didn’t they contact everyone they owe? Un-ass the cash, Allstate!

    I sent in my forms and I have not received anything either I think we all should find out what happen why we did not receive our checks anyone with the 1-800 number should post it and we should file a claim against the administrators of this settlement

    I definitely would have been one of the participants of this class action but just found out about it today.. How does that work when it ended in 2011?

    Received the paperwork and returned it – had a fire and the work was sub-par. When contacted Allstate was told claim was closed. I have a house that had cheap materials put into it and now everything is falling apart. Allstate also dropped us because we did not replace a piece of wood on our door. Luckily we found a new company that has treated us much better in the past 3 years.

    Allstate is up to it’s tricks again. First, we should have been included in the 2011 class action lawsuit, but this is the first we’ve ever heard about it. Too little, too late.

    Next, we’ve suffered some severe storm and hail damage in recent years and filed two claims (3.5 years apart), and Allstate low-balled us to the point it cost us three times the amount to make repairs and replace roof and windows. Little did we know, a phone call to inquire about another claim that again tore off half our roof would result in a possible cancellation on both homeowners and vehicle policies.

    If that wasn[‘t enough, we have learned the use it or lose it crap that Allstate and other insurance carriers pull on you. Plus, not only do these claims and inquiries go on your record, but it stays with your home should you decide to sell and it follows YOU if you decide to move. What kind of crap is this!?

    The industry needs a total overhaul, and the secret practices of CEO’s and adjusters need to end and the focus put back on the policyholders who pay to remain covered under the policies that state they are covered! Shareholders be damned, I would never have signed up to Allstate had I known that their primary focus was on paying the shareholders and CEO’s long before paying their policyholders. No wonder Allstate has a bad rap, they are going under!

      I replied to the class action suit when contacted in 2010 and I filed the paper work and followed up with the website of Feely Beeson on the status of the class action lawsuit. To date I have not heard anything nor received any notification of a settlement. I suffered a home loss due to fire and I fought tooth and nail within the law to stop the legal robbery of what Allstate was pulling. I too spend much of my own money and credit cards which put me in debt, in order to repair my home. I was elated that someone was able to do something about this continued practice of Allstate. I feel let down and as if I have been violated again by this legal capitalistic system.

    IT’s ashame that if you do not pay your premium the insurance company would cut you off very quickly, but when you are trying to get copensted for damages they look the other way. I had sewage damage in my basement and i want go into details it was that gross. WSSC admitted it was there fault, but i went through allstate instead. I got better respect from wssc than my own insurance company.

    Does anyone have a number to call or a lawyer to talk too? My claim was a big one and we have never heard anything back…. And yes we were one of the parties that paid thousands of dollars out of pocket to contractors….we just need someone to contact or connect with. We were supposed to have received a payment by now….
