Allstate Homeowners Insurance Class Action Settlement

Allstate has reached a proposed class action lawsuit settlement over allegations it shortchanged customers who filed insurance claims for structural losses under their Allstate homeowners policies. If you submitted a claim for a structural loss under an Allstate homeowners insurance policy, you may be able to receive cash benefits from the proposed class action settlement. 
The Allstate class action settlement will resolve a class action lawsuit, titled Feely and Beeson v. Allstate County Mutual Insurance Company, that alleges Allstate did not properly pay general contractor’s overhead and profit (GCO&P) when adjusting claims for structural losses under homeowner’s insurance policies. 
“GCO&P” is an amount that may be charged by a general contractor for, among other things, supervising, scheduling and coordinating work and/or materials supplied by subcontractors in the course of repairing damage to a building or structure. A “Structural loss” means physical damage to a home, mobile or manufactured home, condo, farm/ranch or rental dwelling in the United States while covered by a homeowners insurance policy issued by Allstate.
You’re considered a class member of the Allstate homeowners insurance class action lawsuit settlement if you’ve ever been insured in the United States (except in Ohio or Pennsylvania) and submitted a claim for a covered loss. A covered loss is a structural loss that:
* occurred between September 6, 1996 and December 6, 2010;
* was determined to be covered by a homeowners insurance policy issued by Allstate; and
* resulted in a payment by Allstate between September 6, 1996 and December 6, 2010.
Under the Allstate class action lawsuit settlement, class members will be compensated for Allstate’s alleged failure to include an appropriate amount for GCO&P when it paid certain homeowners insurance claims for structural losses. The class action settlement also requires that, for a period of at least two years, Allstate engage in certain claim practices and make certain disclosures designed to help ensure that GCO&P is paid when appropriate.
The amount of money you can receive under the Allstate settlement will be between 10% and 17.5% of the amount previously paid by Allstate to you to complete the repairs, depending on the method by which the estimate was generated, excluding amounts paid for emergency remediation services, debris removal, licensed professionals, and any specialty contractor overhead and profit or GCO&P previously paid by Allstate.
To get your cash payment under the Allstate class action settlement, you must submit a valid claim form postmarked no later than June 6, 2011

    after reading the thyousands of complaints from allstate customers who filed the documents like i did i called the number of the administrator. got alot of apologies and the canned answer that no documents were recd. (but they knew my information). as usual the lawyers and allstate win and we all got screwed again by both of them. wonder if we could sue the legal entities that filed and handled this too.

    Allstate is at it again in California. Due to the windstorms in November-December 2011, I lost 30 feet of block wall and a good portion of my roof. I was advised by the adjuster that because of the 3 layers of shingles and that I did not have a plywood base, I would need a completely new roof. I was told he would give me 8,000.00 to get started and to have the contractor contact him for any overage. After reading about this class action suit, I wisely refused to have any work done until the full amount of the cost was agreed upon in writing from Allstate. I had the adjuster talk with the contractor to discus the work. The adjustor told him the materials are 8000.00 and that is all he is going to get. So I am more than ready to open another suit for this year.

    who did get the settlement money i turn in all the paperwork that was needed than received a letter that i could not receive any money yet i paid for my roof out of pocket allstate only half paid for patchwork even though i had three roofer stating i needed a roof not patchwork

    I had to claims during the time frame which you mentioned.
    You sent me to claim forms. I completed and returned them to you before the deadline. I received two letters today whic stated there was an absence of circumstances requiring the services of a general contractor. This is not true . On one of the claims I needed a complete roof and repairs to the ceiling in one of my bedrooms which a general contractor was needed. the other claim was for damages during hurricane Ike which resulted in repairs to my roof, ceiling and fence. Please explain to me what is missing.

    I had two claims with Allstate in the time frame but could not locate my receipts. And now I have another. Will this happen again?

    To Allstste I had homeowner insurance with you for a long time .I needed a new roof ,which was not provided by allstate
    in result of not being done my cieling fell in causing more
    damage and my hardwood floor is damage. And damage to
    other parts of the cieling in my home .I was sent a Class
    Action Settlement letter, then I was told a form would be sent
    out in the mail I never recieve. I like a an email or form sent out regarding this settlement. Kindnest Regard Delphine

    Allstate Homeowners Insurance Class Action Settlement
    I called the 800 number and asked what I could expect. They acknowledged that they received my claims and paperwork/proof. I was informed that once all legal proceeded are finalized I should hear from them. He added that payout should occur around Dec 2011 timeframe.
