Allstate Homeowners Insurance Class Action Settlement

Allstate has reached a proposed class action lawsuit settlement over allegations it shortchanged customers who filed insurance claims for structural losses under their Allstate homeowners policies. If you submitted a claim for a structural loss under an Allstate homeowners insurance policy, you may be able to receive cash benefits from the proposed class action settlement. 
The Allstate class action settlement will resolve a class action lawsuit, titled Feely and Beeson v. Allstate County Mutual Insurance Company, that alleges Allstate did not properly pay general contractor’s overhead and profit (GCO&P) when adjusting claims for structural losses under homeowner’s insurance policies. 
“GCO&P” is an amount that may be charged by a general contractor for, among other things, supervising, scheduling and coordinating work and/or materials supplied by subcontractors in the course of repairing damage to a building or structure. A “Structural loss” means physical damage to a home, mobile or manufactured home, condo, farm/ranch or rental dwelling in the United States while covered by a homeowners insurance policy issued by Allstate.
You’re considered a class member of the Allstate homeowners insurance class action lawsuit settlement if you’ve ever been insured in the United States (except in Ohio or Pennsylvania) and submitted a claim for a covered loss. A covered loss is a structural loss that:
* occurred between September 6, 1996 and December 6, 2010;
* was determined to be covered by a homeowners insurance policy issued by Allstate; and
* resulted in a payment by Allstate between September 6, 1996 and December 6, 2010.
Under the Allstate class action lawsuit settlement, class members will be compensated for Allstate’s alleged failure to include an appropriate amount for GCO&P when it paid certain homeowners insurance claims for structural losses. The class action settlement also requires that, for a period of at least two years, Allstate engage in certain claim practices and make certain disclosures designed to help ensure that GCO&P is paid when appropriate.
The amount of money you can receive under the Allstate settlement will be between 10% and 17.5% of the amount previously paid by Allstate to you to complete the repairs, depending on the method by which the estimate was generated, excluding amounts paid for emergency remediation services, debris removal, licensed professionals, and any specialty contractor overhead and profit or GCO&P previously paid by Allstate.
To get your cash payment under the Allstate class action settlement, you must submit a valid claim form postmarked no later than June 6, 2011

    Does anyone have a number to call or a lawyer to talk too? My claim was a big one and we have never heard anything back…. And yes we were one of the parties that paid thousands of dollars out of pocket to contractors….we just need someone to contact or connect with. We were supposed to have received a payment by now….

    I too filed a claim for the damages done during a storm to my roof and ceilings, they paid $5k on a $19k claim and was told forms would be sent that never were. I did send a letter in but have never received anything else any news or updates would be very appreciated,

    i was hit in 2004 3 hurricanes in 6 weeks time and i file a claim i think they didn’t pay me enough on my claim. i keep the claim forms until 2011 and then i destroy them. is there anyway to file now a court claim and get a copy thru allstate of my claim for this court case. please e-mail me back as soon as possible and also call me at 321-438 1634. thank you

    I did have a claim during the lawsuit and a general contractor was not used and I did not receive any money? What can I do now?

    Same everywhere I read on the net about ALLSTATE insurance not paying clients. Hurrican Katrina came and went many years ago, ALLSTATE and the Army Corps of Engineers in New Orleans are on the same page AVOIDING to pay out fir damages. Go figure!!!
    God will punish evil….

    I would like to know the status of the Class Action Suit. I along with my 3 children was forced to move out of my house due to cancellation of my homeowner’s policy that birthed a forced policy on my mortage by my morgage company. I have submitted all requested documentation and have heard no response. I am now begining to believe that even more fraud is taking place. Please, for those of us that were forced out of our homes due to not being able to afford the taxed mortages or merely are just due to a return from this lawsuit, don’t continue to leave us hanging without any updated information on the website since last year. This is very discouraging. You have each of our addresses as you sent out initial class action suit information letters. We deserve the right to know the truth.

    I was told that forms was sent to me in july 2011 which I never received, than I was told that in april 2012. I called in 2011 I was never told that. I was told I would get a letter in dec. 2011 that I didn’t get. I am filing a complaint with the bar.
