Netflix class action lawsuitNetflix has been hit with another class action lawsuit, this time involving subscribers’ privacy. According to the most recent class action lawsuit, Netflix keeps its customers’ personal information and viewing history years after they cancel their membership, in violation of state and federal laws.

The Netflix class action lawsuit alleges the popular movie subscription service maintains a digital record system that details every streaming video or video rental that its subscribers have ordered during the course of their membership. It also allegedly maintains records containing users’ billing and contact information on its server computers for at least two years after a subscriber cancels his or her account with Netflix.

“As a result, Netflix maintains a veritable digital dossier on thousands, if not millions, of former subscribers. These records contain not only the former subscriber’s credit card number, username and password, as well as billing/contact information, but also a highly detailed account of the individual’s video programming viewing history,” says the class action lawsuit. All of this, it adds, is done in violation of state and federal laws, including the Video Privacy Protection Act (VPPA).

The Netflix class action lawsuit is brought on behalf of a proposed class of all individuals and entities in the U.S. that have cancelled their subscriptions to Netflix’s services. It is seeking damages for violations of the VPPA and California’s Customer Records Act, unfair competition, unjust enrichment and breach of fiduciary duty. It is also asking that Netflix be prohibited from keeping former subscribers’ personal information and an order requiring Netflix to destroy its former subscribers’ personally identifiable information and video program viewing histories.

    Netflix just billed me after I have not been a customer for almost a year and a half now and I didn’t rejoin the service. My bank account was missing money and I have to get a new debit card now because they saved my information for billing and allowed my old account to be hacked.

    I just got billed yesterday and now I have to go to my bank to get my debit card destroyed and then get a new one issued because netflix told me that it would take 30 days for refund, um, no, not when my disability check is due to hit the first of the month. Scammers everywhere.

    Dang. I/we are also a Netflix customers too! I have really been getting screwed $$$$$ by these big corporate companies! Every time I click on or scroll down I find another company that has screwed me/us. Companies, I thought we could do anything about until now.
