Boston Scientific Advantage Fit lawsuit filed for pelvic meshA recent Boston Scientific Advantage Fit lawsuit was filed by a California woman, alleging she suffered serious transvaginal mesh complications from the product.

The Boston Scientific Advantage Fit lawsuit alleges the transvaginal mesh product is defective in nature and is prone to cause adverse reactions in patients, but the manufacturer allegedly failed to warn the claimant or the public.

According to the lawsuit, plaintiff Bonnie A. had the Advantage Fit mesh implanted on April 28, 2009, to treat her stress urinary incontinence (SUI). However, not long after the transvaginal mesh was implanted, Bonnie reportedly suffered serious complications related to the pelvic mesh.

Bonnie opted to file a Boston Scientific Advantage Fit lawsuit soon after discovering other patients may have suffered similar events, but more importantly after learning the FDA had released public warnings regarding transvaginal mesh complications.

One of these FDA warnings, released on July 13, 2011, stated that “serious complications associated with surgical mesh for transvaginal repair of POP are not rare.”  Boston Scientific allegedly shared none of this information with consumers nor warned them of the risks.

Overview of Transvaginal Mesh Issues

The FDA has stated that mesh contraction or shrinkage has also been reported in patients, which has reportedly caused vaginal tightening and pain. Transvaginal mesh complications detailed by patients include, but are not limited to:

  • Painful Sexual Intercourse
  • Urination Problems
  • Occurrences of Pelvic Organ Prolapse
  • Vaginal Scarring
  • Perforated Bladder, Bowel, or Blood Vessels
  • Mesh Erosion into the Vaginal Area
  • Infection
  • Internal Organ Injuries

Surgical mesh has been used for transvaginal treatment purposes since the 1970s, with manufacturers producing different products for patients to choose from.

Transvaginal mesh is typically used to treat either pelvic organ prolapse (POP) or SUI, which typically occur when the pelvic wall becomes weakened from traumatic events like childbirth.

Transvaginal mesh is supposed to provide women with a discrete treatment method for these highly personal conditions, but a number of patients have reportedly developed serious complications that compounded their medical condition instead.

This was allegedly the case with Bonnie, who reportedly opted for the Boston Scientific Advantage Fit mesh after it was recommended to her by her physician. He, in turn, had relied on the marketing materials and product information provided by the manufacturer, Bonnie claims.

Overview of Transvaginal Mesh Litigation

Marketing materials reportedly presented the Boston Scientific Advantage Fit mesh as a safe and effective product, and did not mention potentially serious health problems now being experienced by mesh patients.

Bonnie states that she would not have agreed to have the Boston Scientific Advantage Fit mesh implanted if she had known about the risk of serious device complications. Bonnie is seeking multiple damages in her Boston Scientific Advantage Fit lawsuit, including counts of negligence and failure to warn.

Over 100,000 transvaginal mesh lawsuits have been filed against Boston Scientific and other manufacturers, which has formed one of the largest mass torts in the history of the United States. This litigation movement has reportedly already spurred settlement awards for claimants, who filed legal action for negligence.

This Boston Scientific Advantage Fit lawsuit is Case No. 8:18-cv-01326-KES, in the U.S. District Court of Central California, Southern Division.
