Top Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused the maker of Proactiv skin care products of failing to fully inform California customers about its auto-renewal policies.
According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the California Proactiv class action settlement began receiving checks worth as much as $68.51 on July 12, 2017.
If you filed a claim for the Proactive auto-renewal settlement, keep checking your mailbox because payouts are on their way.
The class action settlement resolves allegations that Guthy-Renker LLC automatically enrolled customers into a subscription service after they made an initial Proactiv purchase. According to the lawsuit, customers were automatically charged and sent additional Proactiv skin care products through its auto-renewal policy.
The plaintiff claimed Class Members were unaware of the auto-renewal subscription and did not consent to the terms.
Guthy-Renker denied the allegations but agreed to pay $15.2 million to settle the class action and avoid the risk of further litigation. In addition, the defendant agreed to fully disclose its subscription policy to customers and obtain their permission ahead of time.
Under the terms of the settlement, Class Members had the option of choosing a cash payment or Proactiv skin care products worth $75 or more.
Class Members included all California residents “who, between January 22, 2009 and July 8, 2014, purchased Proactiv products from Guthy-Renker LLC (‘Guthy-Renker’) and, as a result of their purchase, were automatically enrolled in GuthyRenker’s automatic delivery and automatic renewal billing policy and charged for additional products and shipments beyond their initial purchase.”
The deadline to file a claim for the Proactiv class action settlement passed on April 17, 2017.
