Blackboard is a system used by schools and other organizations to send parents notifications regarding student absences or district-wide announcements such as school closures or emergency alerts.
Illinois resident Rafael Valladares filed the class action lawsuit over allegations that Blackboard sent him numerous calls and texts on behalf of a Chicago elementary school despite not having a child enrolled at that particular school.
The plaintiff claimed he made repeated attempts to have the calls and texts stop but they continued.
Blackboard denied violating the TCPA but agreed to pay $7.5 million to settle the claim and avoid ongoing litigation.
Class Members included both individuals and entities who received “non-emergency calls or text messages sent using Blackboard Equipment between December 22, 2010 and September 1, 2016 to which you had not consented or for which you had previously withdrawn consent.”
The deadline to file a claim for the Blackboard class action settlement passed on Nov. 21, 2016.
