A group of five women are suing Bayer and related companies over the birth control pills Yaz and Yasmin. The group birth control lawsuit accuses the defendants of failing to warn that Yaz and Yasmin increase the risk of dangerous blood clots, leading to heart attack, stroke and death.
Yaz and Yasmin belong to a group of birth control pills that contain a synthetic estrogen called Drospirenone. These represent a fourth-generation of hormone-based birth control pills. Earlier versions of “the pill” were associated with various side effects, including a risk of developing blood clots in critical blood vessels. However, it has been alleged — and supported by researchers — that Drospirenone-based birth control pills may have an even higher risk of blood-clot related medical problems.
Blood clots can cause a variety of serious medical problems. When blood clots form within the body, they can block the supply of blood to critical tissues. For example, when a blood clot forms within the blood vessels between the heart and the lungs, it can cause a pulmonary embolism or PE. PEs can vary wildly in their severity depending on the exact position of the clot. In some cases, they may block the blood supply to the lungs, or strain the heart and cause it to fail quickly. While these medical emergencies typically happen later in life, the legal action against Yaz/Yasmin alleges that women as young as 17 have suffered from complications including stroke and pulmonary embolism from using these pills.
The legal action against Bayer now includes thousands of birth control lawsuits filed by women who claim they were severely injured by Yasmin and/or Yaz. The consolidated litigation is similar to a Yaz class action lawsuit but each woman retains her own attorney and Yaz settlement, if awarded.
In the recently filed Yaz/Yasmin lawsuit, all five plaintiffs either suffered from deep vein thrombosis, pulmonary embolism, or both. Deep vein thrombosis (DVT) occurs when a blood clot forms in the large blood vessels of the leg. DVT is a concern because it can cause pain and swelling of the leg, and because the blood clot can dislodge and cause a pulmonary embolism, stroke, or other clot-related emergencies.
Of the women in the Yaz birth control lawsuit, plaintiffs Aleandria Najduch and Latonia Barrow suffered pulmonary embolisms, while Gloria Valez had a DVT, and both Gwen Davis and Gladys Nieves had both PEs and DVTs. Since DVTs and PEs are so closely related, this combination is not surprising.
The group Yaz lawsuit is Alexandria Najduch, et al., vs. Bayer Healthcare Pharmaceuticals et al, Case no. 3:14-cv-10173-DRH-PMF, filed within the Yaz MDL In Re: Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Relevant Products Liability Litigation, MDL No. 2100, filed in the United Sates District Court for the Southern District of Illinois.
