A newer device, Essure birth control, has provided a viable option for women seeking permanent birth control, but the device has been under fire recently over many serious allegations including Essure false marketing tactics.

Essure False Marketing Tactics Lawsuit

An Illinois woman has filed a lawsuit against Essure manufacturer, Bayer, citing many damages including Essure false marketing tactics and concealing health risks from doctors and the public.

Plaintiff Chasity E. sought out permanent birth control in July 2015. Her doctor offered her an Essure brochure and discussed the Essure procedure with her.

She claims she relied on the marketing materials to decide to become implanted with the Essure device.

On July 29, 2015, Chasity underwent the Essure procedure. However, at her standard follow-up appointment her physician found bilateral proximal tube occlusion.

After the surgery and her follow-up appointment, the plaintiff began to suffer from chronic pelvic pain, menorrhagia and cramping.

In June 2016, she underwent a hysterectomy (removal of the uterus) and a bilateral salpingectomy (removal of the fallopian tubes) to attempt to alleviate her symptoms and give her some relief.

Chasity believes that had she known about the risks and had Bayer not engaged in Essure false marketing tactics, she would have not made the decision to undergo the Essure procedure.

The plaintiff claims that because Bayer’s “misconduct and fraudulent concealment of the relevant facts deprived Plaintiff and her physicians of vital information essential to the pursuit of these claims, without any fault or lack of diligence on their part.”

She says she could not have reasonably known or become aware of facts that would lead a reasonable, prudent person to ask questions about the Essure false marketing tactics.

Chasity raises claims of negligence, manufacturing defect, failure to warn, fraud, negligent misrepresentation and consumer protection violations.

She alleges that Bayer should have known that Essure was dangerous and ineffective, that they concealed the dangers and health risks from the medical community and public and that they engaged in Essure false marketing tactics by misrepresenting the safety and efficacy of the device.

The plaintiff also claims that when Bayer did understand all the risks associated with Essure, they still advertised, distributed and sold Essure.

What is Essure?

Essure is manufactured by Bayer and is promoted as a permanent, non-surgical and safe form of birth control. Upon release, women and physicians considered it a groundbreaking device for women who wished to be permanently sterile.

The Essure device was approved by the FDA in 2002 though a fast-track review system.

Essure consists of two flexible coils made of metal and polyester that are inserted through the vagina and uterus and are placed inside the fallopian tubes of the patient. Over the next few months, tissue begins to develop around the metal coils. This blocks conception.

After three months, patients must be evaluated by their doctors to make sure that the procedure worked as planned.
