Hi-Tech Pharmaceuticals Fastin DMAA Class Action Lawsuit

FastinA federal class action lawsuit claims Hi-Tech Pharmaceuticals markets a weight-loss product called Fastin that contains a dangerous and illegal synthetic form of DMAA.
 
Hi-Tech Pharmaceuticals claims in its marketing that “Fastin will help you lose weight and feel great,” and that Fastin’s ingredients will “produce extreme energy and promote a sense of well-being.”
 
“What Defendant fails to mention is that its Product contains the dangerous ingredient, Dimethylamylamine, also known as DMAA,” the class action lawsuit states.
 
DMAA is an amphetamine-like compound that purports to boost weight-loss efforts by increasing energy and metabolism. It is naturally derived from the geranium plant, but many supplement manufacturers have using a synthetic form of DMAA that the FDA warns can be dangerous, and has been linked to rapid heartbeat and heart attacks in some users.
 
A recent FDA crackdown on supplement manufacturers using synthetic DMAA in their weight-loss products has prompted several class action lawsuits seeking redress for consumers misled into believing the products were safe.
 
According to the Fastin class action lawsuit, the form of DMAA that Hi-Tech Pharmaceuticals uses in Fastin is the synthetic form, which “is both illegal and dangerous. Defendant’s advertising statements, which fail to mention the risks associated with this ingredient, are both false and misleading to consumers.”
 
“Before marketing a Product containing DMAA, manufacturers and distributors have a responsibility under the law to provide evidence of the safety of its Product. Defendant has failed to do that, which made Fastin adulterated” and unlawfully on the market, the class action lawsuit continues. 
 
The Fastin DMAA class action lawsuit is brought on behalf of a proposed class of all U.S. citizens or residents who purchased Fastin within the past four years. It is seeking injunctive relief as well as restitution and disgorgement, statutory damages, general damages, special damages, attorneys’ fees and costs.
