Uber Lyft Price Fixing Class Action Lawsuit Overview: 

  • Who: Taje Gill, Esterphanie St. Juste, and Benjamin Valdez filed a class action lawsuit against Uber Technologies, Inc. and Lyft, Inc. 
  • Why: Gill, St. Juste, and Valdez claim Uber and Lyft have created a duopoly with their ride hailing services and are suppressing competition for driver pay and working conditions. 
  • Where: The class action lawsuit was filed in California Superior Court. 

Uber and Lyft exploit their drivers while maintaining a duopoly with their ride hailing services, a new class action lawsuit alleges. 

Plaintiffs Taj Gill, Esterphanie St. Juste, and Benjamin Valdez claim Uber and Lyft are violating California antitrust and consumer protection laws while depriving their drivers of “economic independence.”

Gill, St. Juste, and Valdez, all current Uber and Lyft drivers, claim the rideshare companies are doing what is known as “vertical price fixing,” which they argue “harms drivers and customers by allowing Uber and Lyft to increase customer prices even while suppressing driver pay.” 

Further, the drivers argue Uber and Lyft have adopted price restraints aimed at suppressing competition between the two companies in regard to working conditions and compensation for drivers.

“Defendants label their drivers independent contractors, yet deprive those drivers of economic independence by fixing the prices that drivers must charge to customers for rides,” states the Uber class action. 

Gill, St. Juste, and Valdez want to represent a California Class of individuals who have driven for Uber or Lyft within the past four years and who have opted out of the companies arbitration agreements. 

The drivers claim Uber and Lyft limit their drivers’ compensation in order to give them “no choice but to participate in game-like compensation packages that offer drivers a premium payment.” 

An example of a “game-like compensation package,” according to Gill, St. Juste, and Valdez, is for Uber/Lyft to offer higher pay for completing a set number of trips within a short period.

“These practices are designed to make it harder for Uber and Lyft drivers, nominally independent contractors, to switch between ride-hailing platforms based on which would pay them more,” states the Lyft class action. 

Gill, St. Juste, and Valdez claim Uber and Lyft are in violation of California’s Cartwright Act, Unfair Competition Law and Business and Professions Code

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with treble and punitive damages for themselves and all Class Members.    

 Uber agreed in April to an $8.44 million settlement made to resolve claims it misclassified its drivers as independent contractors.

    Health care stipends Active time Missing or changed by Uber.
    Uber has this health care program for drivers who have medical insurance. So if you have Validated medical insurance outside of Uber . If you reach 325 active hours in a quarter equalify for $1,274 or if you get 195 Active hours qualifies you for $637. Well Uber is changing you’re active hourso that it takes you longer to get it or makes it to wear you don’t get it and you lose out but you did all this time working and the change of working active hours so that you don’t qualify for that quarter. I have all the proof that Uber has done this and is still doing it to me and maybe everyone else. There’s a attorney interested in this please contact me.

      Would love to hear from you. And I also have a question to ask as well. Uber stop collecting airport drop off fee since Uber was sued and paid 1.8m. Now Uber learn the mistake and charged airport drop-off fee from drivers instead 🤣🤣 why do drivers that are only dropping off passengers have to pay $4 a trip? passengers paid for airline ticket that includes airport fee already. Airport fee includes airport road maintenance- so passengers paid for airport fee that cover to all amenities-road, traffic light, maintenances. Uber deducted $4 a trip from a driver as an airport fee, Uber deduct fee as expenses(health care, credit card fee, other expenses), Uber deduct Uber fee(connectsaver) <<—- you mean connect server? Last time I check Uber shows upfront that drivers would think that it was 50-50. If I ever know that Uber changed their mind and charged airport drop-off fee from drivers I wouldn’t do it. 🤣🤣 I mean it airport drop-off fee in 2015 that Uber charge from passengers. Uber got sued and lost 1.8m. Now, Uber never make a mistake again, Uber switched to charge a contractor that drop-off those passengers instead. The problem is those contractors did not realize these hidden fee. Whistleblowers~

    I work for both Uber and Lyft. And feel that I should be making more than what they are paying. Riders tell me they pay like $15 or more for their rides but I get maybe $3 or $4 dollars of the fee. I am putting the wear and tear on my vehicle not them.

    Buenos días todas la quejas leídas arriba son las mismas que me pasan. Ahora, tengo del 1 de mayo 2023 hasta ahora 16 de mayo 2023 y Lyft no hace nada al respecto, actualicé toda mi información y ellos no resuelven nada y no tiene servicio al cliente o sea no se que hacer más

    Soy conductor con lift ase 6 meses atrás 2 beses me encargaron mi salario sin darme ninguna razón quien me avía encargado mi salario 3 beses fue suspendida mi cuenta temporal mente por supuestos comentarios en mi contra nada comprobado manipulaban mis ganancias al punto de darme viajes largos de 40 millas por una ganancia de $16 dólares y esta última vez me suspenden mi cuenta permanentemente
    Por supuesto comentario inapropiado que supuesta mente yo le avía dicho a un cliente sobre mi religión sin Aver me conprovado nada algún abogado puede ayudarme en mi caso
