Uber Lyft Price Fixing Class Action Lawsuit Overview: 

  • Who: Taje Gill, Esterphanie St. Juste, and Benjamin Valdez filed a class action lawsuit against Uber Technologies, Inc. and Lyft, Inc. 
  • Why: Gill, St. Juste, and Valdez claim Uber and Lyft have created a duopoly with their ride hailing services and are suppressing competition for driver pay and working conditions. 
  • Where: The class action lawsuit was filed in California Superior Court. 

Uber and Lyft exploit their drivers while maintaining a duopoly with their ride hailing services, a new class action lawsuit alleges. 

Plaintiffs Taj Gill, Esterphanie St. Juste, and Benjamin Valdez claim Uber and Lyft are violating California antitrust and consumer protection laws while depriving their drivers of “economic independence.”

Gill, St. Juste, and Valdez, all current Uber and Lyft drivers, claim the rideshare companies are doing what is known as “vertical price fixing,” which they argue “harms drivers and customers by allowing Uber and Lyft to increase customer prices even while suppressing driver pay.” 

Further, the drivers argue Uber and Lyft have adopted price restraints aimed at suppressing competition between the two companies in regard to working conditions and compensation for drivers.

“Defendants label their drivers independent contractors, yet deprive those drivers of economic independence by fixing the prices that drivers must charge to customers for rides,” states the Uber class action. 

Gill, St. Juste, and Valdez want to represent a California Class of individuals who have driven for Uber or Lyft within the past four years and who have opted out of the companies arbitration agreements. 

The drivers claim Uber and Lyft limit their drivers’ compensation in order to give them “no choice but to participate in game-like compensation packages that offer drivers a premium payment.” 

An example of a “game-like compensation package,” according to Gill, St. Juste, and Valdez, is for Uber/Lyft to offer higher pay for completing a set number of trips within a short period.

“These practices are designed to make it harder for Uber and Lyft drivers, nominally independent contractors, to switch between ride-hailing platforms based on which would pay them more,” states the Lyft class action. 

Gill, St. Juste, and Valdez claim Uber and Lyft are in violation of California’s Cartwright Act, Unfair Competition Law and Business and Professions Code

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with treble and punitive damages for themselves and all Class Members.    

 Uber agreed in April to an $8.44 million settlement made to resolve claims it misclassified its drivers as independent contractors.

    I’m glad to find this page. I’ve been questioning Lyfts way of paying and it’s game like compensation. It’s all a set up and manipulation. The “glow bonuses” is a scam. It creates a circle around you so you don’t get bonus and It forces you to drive to it and when you do it disappears. At times, there’s a glow and new ride and it was in the glow and never got bonuses. I’ve had passengers tell me they tip on app and I don’t get it. They are more issues with how the app works and it’s all manipulation. I asked and saw passengers when they try to add stop, The new charge 20$ But I only got 5$. I was with s passenger for 30 min and only got 5$. During morning times, charging riders 20$ Cuz it’s busy but I only got 3$ out of it. This is crazy. Last straw, my damage waiver disappeared in my account and they tried to blame it on me and it took them days to get anything from them. We can’t even call customer service. Thr help desk is a failure. So much more issues. I have screenshots and screen recordings of these things. I’m new and was making money but all of a sudden it slowed down on me and barely making any. You know when you get those guaranteed earnings report? I was way above and now I’m way below. LYFT IS A SCAM!!!

          Same here. They tried to get me to go 94 miles for 50.00 not happening.

          I had a 4-1/2 hour ride from Albuquerque to Carlsbad and was only paid $143.00. I’ve made numerous requests to Lyft regarding their Upfront fees, and they refuse to provide a breakdown. Mileage alone (264 mi X .64/mi) should have been over $180.00 and time should have been $27.00. = $213.00 total, and Lyft ripped me off over $70.00. Lyft’s new “Upfront fee” is shady and do not show a breakdown of miles and minutes…It’s as if Lyft pulls a figure “out of thin air”, but does not provide justification as they they refer their upront fees as “estimates”, and should not be the final bill.

            Wow, I just had this happen to me on a Lux ride. My mileage rate came out to almost half of what my rate card states (or 85% of my mileage and my time was free, however you want to slice it). I’m not in California but would join a similar suit in my state. If you cover suits in other states (or have info of how the suit is going), please message me. I asked many times for a breakdown of the trip and they refuse to provide one and keep saying I accepted the ride and the payment is correct. Legit question: Did something in the “independent contractor” agreement change nullifying out rate cards? I don’t remember anything to that effect.

        Today 45.00 dollar ride client paid and Lyft gave me 15 keeping 30 for themselves and then I asked another driver who paid 29.00 and Lyft gave me 8.55 its been really bad last few months, greedy bastards. Missing tips as well

    I used to drive and get much less money than I’m used to getting I’ve been driving for a Lyft for 8 years so I know what the pricing is like and it is really changed for the worst sometimes less than half and I call and speak to customer service and they tell me that nothing has changed and they send me the rate but I know it’s changed I’ve been driving for 8 years and I know what you’re supposed to get each ride so something has to give that’s all I’ve been talking about for the past year I was saying to myself I have to get another job because this is just ridiculous now
