Uber Lyft Price Fixing Class Action Lawsuit Overview: 

  • Who: Taje Gill, Esterphanie St. Juste, and Benjamin Valdez filed a class action lawsuit against Uber Technologies, Inc. and Lyft, Inc. 
  • Why: Gill, St. Juste, and Valdez claim Uber and Lyft have created a duopoly with their ride hailing services and are suppressing competition for driver pay and working conditions. 
  • Where: The class action lawsuit was filed in California Superior Court. 

Uber and Lyft exploit their drivers while maintaining a duopoly with their ride hailing services, a new class action lawsuit alleges. 

Plaintiffs Taj Gill, Esterphanie St. Juste, and Benjamin Valdez claim Uber and Lyft are violating California antitrust and consumer protection laws while depriving their drivers of “economic independence.”

Gill, St. Juste, and Valdez, all current Uber and Lyft drivers, claim the rideshare companies are doing what is known as “vertical price fixing,” which they argue “harms drivers and customers by allowing Uber and Lyft to increase customer prices even while suppressing driver pay.” 

Further, the drivers argue Uber and Lyft have adopted price restraints aimed at suppressing competition between the two companies in regard to working conditions and compensation for drivers.

“Defendants label their drivers independent contractors, yet deprive those drivers of economic independence by fixing the prices that drivers must charge to customers for rides,” states the Uber class action. 

Gill, St. Juste, and Valdez want to represent a California Class of individuals who have driven for Uber or Lyft within the past four years and who have opted out of the companies arbitration agreements. 

The drivers claim Uber and Lyft limit their drivers’ compensation in order to give them “no choice but to participate in game-like compensation packages that offer drivers a premium payment.” 

An example of a “game-like compensation package,” according to Gill, St. Juste, and Valdez, is for Uber/Lyft to offer higher pay for completing a set number of trips within a short period.

“These practices are designed to make it harder for Uber and Lyft drivers, nominally independent contractors, to switch between ride-hailing platforms based on which would pay them more,” states the Lyft class action. 

Gill, St. Juste, and Valdez claim Uber and Lyft are in violation of California’s Cartwright Act, Unfair Competition Law and Business and Professions Code

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with treble and punitive damages for themselves and all Class Members.    

 Uber agreed in April to an $8.44 million settlement made to resolve claims it misclassified its drivers as independent contractors.

    Tengo trabajando con lyft 2mese y todo el tiempo de una forma o otra pagan menos siempre acomodan las cartas a su favor nunca resuelven nada y la manera de precionarte para aceptar los raites es que tienes que mantener sierro porcentaje de rates aceptados para que puedas ver la estimacion del raite el día de hoy me tomo 7 minutos ir a levantar al pasajero mas el tiempo en ir a llevarlo salieron que mi viaje era de 4 minutos y solo me paga

    I live in Rockford illinois where minimum wage is $12 and I’ve gotten fed up with Lyft and Uber keeping majority of the cost and customers not tipping especially in bad weather conditions.

    I sent this text out to all riders on a bad snowy weekend after the first 2 days of no tips. And actually got the most tips ever(7) in Rockford. When my average is 25 trips a day w/1 tip(s). Over 3k trips 5star rating.

Due to the fact that only 2% of Rockfordian’s are giving drivers tips and just lie about adding them after the trip. I will not wait the allotted 5 mins (we are not paid for waiting). PLEASE BE READY WHEN I ARRIVE. I’m trying to do as many rides as I can. Lyft only gives drivers $3-7 on average of the $7-17 you pay for rides in town. I DRIVE BECAUSE OF THE FLEXIBILITY being a full-time parent and student, but we pay for everything out of pocket like fuel and maintenance
    LYFT ONLY gives us 1/3 of your cost no matter the road conditions. We rely on gratuity. See you soon, if lyft doesn’t change the rider.”

    Agreed, I drive and drive and make no profit. I did an Uber eats delivery and accepted it for $16 and when completed I was paid $10!!!!’ Add Me

    Lift just ripped me in my boyfriend off for our referral bonuses I completed my 200 rides within the 30 day period they owe us both $800 not to mention when you sign up it clearly states we the driver get 60% uber and lyft get 40 bit that is not what’s going on we are getting way less than 40% and they are stealing tips from drivers. Please add me to this 🙏🏽

    I totally agree sign me up to get re-compensated for all the lost wages, earnings, and hours. I am over charged, almost injured, rejected a proper rating to each driver.

    Hi, I am a currrent Lyft driver and am experiencing everything that has been mentioned above, except for permanent deactivation (they still tried twice). I would rather not publish my name because I am still working for Lyft, but I would be interested in joining this lawsuit.
